A copy of the full City Council packet, including EDA (Economic Development Authority), is available to the public. The packet ring binder is located at the front of the Council Chambers by the Secretary. 2.Roll Call 3.Approval of Agenda and Consent Agenda —The following items are considered to be routine by the Economic Development Authority (EDA) and will be enacted by one motion. There will be no separate discussion of these items unless a Commissioner so requests, in which event the item will be removed from the consent agenda and considered at the end of Commission Consideration Items. a. Resolution Approving Transfer and Conveyance of a Parcel of Property to the City of Brooklyn Center for Use in a Land Exchange for a Public Trail (3401 53rd Ave N) —On August 10, 2015, the EDA called for a Public Hearing to be held August 24, 2015; notice was published in the official newspaper on August 13, 2015. Requested Commission Action: —Motion to open Public Hearing. —Take public input. —Motion to close Public Hearing. —Motion to adopt resolution. 5.Adjournment EDA Agenda Itemkuutir. MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION AUGUST 10, 2015 CITY HALL - COUNCIL CHAMBERS 1.CALL TO ORDER The Brooklyn Center Economic Development Authority (EDA) met in Regular Session called to order by President Tim Willson at 7:42 p.m. 2.ROLL CALL President Tim Willson and Commissioners April Graves, Kris Lawrence-Anderson, Lin Myszkowski, and Dan Ryan. Also present were Executive Director Curt Boganey, Director of Business and Development Gary Eitel, Assistant City Manager/Director of Building and Community Standards Vickie Schleuning, City Attorney Troy Gilchrist, and Denise Bosch, TimeSaver Off Site Secretarial, Inc. 3.APPROVAL OF AGENDA AND CONSENT AGENDA Commissioner Ryan moved and Commissioner Graves seconded to approve the Agenda and Consent Agenda, and the following item was approved: 3a. APPROVAL OF MINUTES 1. July 27, 2015 - Regular Session Motion passed unanimously. 4.COMMISSION CONSIDERATION ITEMS 4a. RESOLUTION NO. 2015-17 CALLING FOR A PUBLIC HEARING REGARDING THE PROPOSED TRANSFER AND CONVEYANCE OF A PARCEL OF PROPERTY TO THE CITY (340153 R AVENUE N.) Executive Director Curt Boganey introduced the item, discussed the history, and stated the purpose of the proposed resolution. Commissioner Ryan noted that the City Council/EDA has looked at this resolution in considerable detail and been thoroughly briefed. Conveyance of the property is the next logical step in the process. 08/10/15 -1- DRAFT Commissioner Ryan moved and Commissioner Graves seconded to adopt RESOLUTION NO. 2015-17 Calling for a Public Hearing Regarding the Proposed Transfer and Conveyance of a Parcel of Property to the city (340153 rd Avenue N.) ADJOURNMENT Commissioner Lawrence-Anderson moved and Commissioner Myszkowski seconded adjournment of the Economic Development Authority meeting at 7:45 p.m. Motion passed unanimously. 08/10/15 -2- DRAFT EDA Agenda Item urNo. EPA ITEM MEMORANDUM DATE: August 24, 2015 TO: Curt Boganey, Executive Director FROM: Vickie Sch1euning ssistant City Manager/Director of Building & Community Standards SUBJECT: Transfer and Conveyance of a Parcel of Property to the City of Brooklyn Center For Use in a Land Exchange for a Public Trail (3401 53'' Ave N) Recommendation: It is recommended that the Economic Development Authority (EDA) conduct a Public Hearing and adopt a resolution to transfer and convey a parcel of property to the City of Brooklyn Center for use in a land exchange for a public trail. Background: The EDA is conducting a Public Hearing on August 27, 2015 to consider the transfer and conveyance of a property owned by the EDA to the City of Brooklyn Center for use in a land exchange for a public trail. The EDA owned property is currently a vacant lot located at 3401 53rd Ave N, adjacent to Lake Pointe Apartments. The land exchange to create a public trail would be with Lake Point Properties LLC, the owner of Lake Pointe Apartments. On August 10, 2015, the EDA called for a Public Hearing, and the Public Notice was published in the official newspaper on August 13, 2015. A summary of the steps required to execute the land exchange is: • EDA conduct a Public Hearing and approve a resolution authorizing a Land Exchange Agreement and conveyance of the Subject Property to City. (Consideration on 08/24/2015) • City Council approved an Ordinance approving the Land Exchange Agreement and authorizing the conveyance of the Subject Property to Lake Point Apartments LLC in exchange for a Trail. The ordinance was approved on July 27, 2015, with an effective date of August 28, 2015. (First reading conducted on 7/13/2015, Public Hearing and second reading completed on 07/27/2015.) • All parties sign the Land Exchange Agreement, setting out the details of the exchange. • Thirty days after publication of the ordinance, the closing of the exchange of the Subject Property deed to Lake Point Apartments LLC and for a Trail executed by the City and Lake Point Apartments, LLC will occur on or shortly after 08/28/2015. Construction may occur earlier if an agreement is signed between the City of Brooklyn Center and Lake Point Apartments LLC. City staff will work with Three Rivers Park District to design and construct the trail. The construction of the trail is tentatively planned for fall 2015, and is included in the Capital Improvement Plan. Mission: Ensuring an attractive, clean, safe, inclusive community that enhances the quality of life for all people and preserves (lie public trust EPA ITEM MEMORANDUM Due to a recent change in the ownership composition of Lake Point Apartments LLC, they have offered to convey the land for the trail to the City in fee rather than just an easement. Staff is working with the City Attorney's office to develop a land exchange agreement to accomplish the land exchange and allow the scheduled construction of the trail. The actions of the City Council and EDA will not go into effect unless an acceptable land exchange agreement is implemented. The authorizations already provided by the City Council allow Staff to negotiate a final land exchange agreement for signature by the Mayor and Manager. Budget Issues: The costs associated with this transaction are budgeted out of the TIF 3 Housing Fund. RESOLUTION APPROVING TRANSFER AND CONVEYANCE OF A PARCEL OF PROPERTY TO THE CITY OF BROOKLYN CENTER FOR USE IN A LAND EXCHANGE FOR A PUBLIC TRAIL (3401 53 AVE N) WHEREAS, the Economic Development Authority of Brooklyn Center, Minnesota ("EDA") owns a parcel of property described as the North 110.02 feet of the East 142.6 feet of the Northwest Quarter of the Northeast Quarter of Section 10, Township 118, Range 21, Hennepin County, Minnesota (Torrens Certificate of Title No. 1353209) ("Subject Property"); and WHEREAS, the EDA proposes to transfer and convey the Subject Property to the City of Brooklyn Center ("City") to enable a land exchange with Lake Point Apartments LLC to create a public trail; and WHEREAS, the Notice of Public Hearing was published in the City's official newspaper on August 13, 2015; and WHEREAS, the EDA held a Public Hearing regarding the proposed transfer and conveyance of the Subject Property on August 24, 2015. NOW, THEREFORE, BE IT RESOLVED, by the EDA of Brooklyn Center, Minnesota that: 1. The EDA authorizes the transfer and conveyance of the Subject Property to the City to facilitate the creation of a public trail. August 24, 2015 Date President The motion for the adoption of the foregoing resolution was duly seconded by Commissioner and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted.
