its adoption:
RESOLUTION NO. qnnL-hp
RESOLUTION AUTHORIZING TERMINATION OF CONTRACT WITH
BOSSARDT CORPORATION
WHEREAS, by Resolution No. 97-218 the Mayor and City Manager were
authorized to execute a contract with Bossardt Corporation for construction management services
related to the police and fire building projects; and
WHEREAS, legal counsel has advised that it would be appropriate for the City to
terminate its contract with the Bossardt Corporation; and
WHEREAS, such recommendation is based upon a review of the performance of
service by Bossardt Corporation, which review indicates that Bossardt Corporation is in breech
of its contractual obligations and the City would be better served by completing the final portions
of the police and fire projects itself.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the City Manager be and hereby is authorized to terminate and provide notice
of termination of the contract between the City of Brooklyn Center the Bossardt Corporation as
provided in the contract with Bossardt Corporation for termination.
AND, BE IT FURTHER RESOLVED, that the City Manager be and hereby is
authorized through the law firm of Fabyanske, Westra and Hart to continue to pursue appropriate
remedies and resolution of issues surrounding contractual performance of the Bossardt
Corporation.
