HomeMy WebLinkAbout2017-041 CCR Member April Graves introduced the following resolution and moved its adoption: RESOLUTION NO. 2017-41 RESOLUTION APPROVING THE SEVENTH AMENDMENT TO JOINT POWERS AGREEMENT FOR STREET MAINTENANCE ACTIVITIES WHEREAS, representatives from the cities of Brooklyn Center, Coon Rapids, Anoka, Andover, Fridley, Ham Lake, Columbia Heights, Mahtomedi, East Bethel and Circle Pines (hereinafter collectively the "Cities") form the North Metro Regional Street Maintenance Consortium for street maintenance work including traffic markings, street sweeping, crack sealing, screening and seal coating for the purpose of gaining a financial benefit by combining this work for bidding purposes; and WHEREAS, the Cities operate and manage the consortium under the current Joint Powers Agreement (JPA) dated February 1, 2005, revised by Amendments First through Sixth; and WHEREAS, the current agreement includes a 20-day comment period and a subsequent 30-day opting out period once the bids are received; and WHEREAS, the new Seventh Amendment to the JPA combines and provides for a concurrent 30-day comment period and 30-day written opt-out notification period, which provides the contractor more time to perform the contracted work. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that the Mayor and City Manager are hereby authorized to execute the Seventh Amendment to JPA regarding a modification to the comment and opt-out period.
