INFORMAL OPEN FORUM WITH CITY COUNCIL CALL TO ORDER INFORMAL OPEN FORUM The Brooklyn Center City Council met in Informal Open Forum called to order by Mayor Tim Willson at 6:45 p.m. ROLL CALL Mayor Tim Willson and Councilmembers April Graves, Kris Lawrence -Anderson, and Dan Ryan were present. Councilmember Marquita Butler was absent and excused. Also present were City Manager Curt Boganey, Deputy City Manager Reggie Edwards, Public Works Director/City Engineer Steve Lillehaug, Director of Business and Development Gary Eitel, Deputy Director of Building and Community Standards Jesse Anderson, City Attorney Troy Gilchrist, and Michaela Kujawa-Daniels, TimeSaver Off Site Secretarial, Inc. Mayor Tim Willson opened the meeting for the purpose of Informal Open Forum. Octavious Hney, 2806 Northway Drive, addressed the City Council and stated he has lived here for years and loves the City. He stated two years ago they held the Liberian Independence Day celebration at the Brooklyn Center High School, and despite it being a family friendly event there had been some issues with tobacco and alcohol use on the property. He stated as a result the City will not grant them a permit for the event anymore. He stated he reached out to the Brooklyn Center Police Department to get some information on the incident and to see if they can re-establish the good relationship they had before some foolish people ruined the event for everyone but was advised that the police cannot do anything about this issue, so he decided to ask the City Council for help with this issue. Mayor Willson stated the City Council does not have any answers for him tonight but City Manager Boganey will follow-up with the Police Department and see what happened in the past and if they are able to do anything regarding getting a permit to hold the event this year in Brooklyn Center at the High School. Councilmember Lawrence -Anderson asked if they have had any alcohol and/or tobacco use issues in the past few years elsewhere. Mr. Hney replied no, they have a good relationship with the City of Brooklyn Park and they could call and use them as a reference, if needed, as well as the City of Osseo. 04/24/17 -1- Roger Kloster, 7223 Lee Avenue North, addressed the City Council, stating he just paid his water bill and noticed there was a caption on the bill that says a 10% late fee or $3.00 whichever is lesser will be charged to the account if the bill isn't paid by the due date. He stated he always pays his bill early and if they can charge for late payments, he would like to know if he can get a reduction on his bill for paying it early. Mayor Willson stated that the administration fee doesn't change if a bill is paid on time but it does change if it is past due. Mr. Kloster stated he understands and just wanted to check because he pays his bill early every month. He noted it is something to look into, like a coupon and incentive to pay your bill early. Councilmember Ryan moved and Councilmember Graves seconded to close the Informal Open Forum at 6:55 p.m. Motion passed unanimously. 2. INVOCATION Mayor Willson stated he would like to pray for all the elected officials in hopes they can stay on a peaceful agenda and for those using weapons of mass destruction to stop the destruction. He requested a moment of silence and personal reflection as the Invocation. 3. CALL TO ORDER REGULAR BUSINESS MEETING The Brooklyn Center City Council met in Regular Session called to order by Mayor Tim Willson at 7:00 p.m. 4. ROLL CALL Mayor Tim Willson and Councilmembers April Graves, Kris Lawrence -Anderson, and Dan Ryan were present. Councilmember Marquita Butler was absent and excused. PRESENTATIONS/PROCLAMATIONS/RECOGNITIONS/DONATIONS 7a. PROCLAMATION DECLARING APRIL 28, 2017, TO BE ARBOR DAY AND MAY 2017 TO BE ARBOR MONTH IN BROOKLYN CENTER Mayor Willson read in full a Proclamation Declaring April 28, 2017, to be Arbor Day and May 2017 to be Arbor Month in Brooklyn Center. Councilmember Ryan stated he would like to mention the generous contribution of $250 from the American Legion and Sons of the American Legion. Councilmember Ryan moved and Councilmember Graves seconded to adopt the Proclamation Declaring April 28, 2017, to be Arbor Day and the Proclamation Declaring May 2017 to be Arbor Month in Brooklyn Center. Motion passed unanimously. 7b. PROCLAMATION DECLARING MAY 21-27,2017, PUBLIC WORKS WEEK IN THE CITY OF BROOKLYN CENTER Mayor Willson read in full a Proclamation Declaring May 21-27, 2017, to be Public Works Week in the City of Brooklyn Center. Councilmember Graves moved and Councilmember Lawrence -Anderson seconded to adopt the Proclamation Declaring May 21-27, 2017, to be Public Works Week in the City of Brooklyn Center. Mayor Willson stated he thinks very highly of the City Staff and is pleased to read this Proclamation. Motion passed unanimously. 8. PUBLIC HEARINGS 04/24/17 -5- None. 9. PLANNING COMMISSION ITEMS 9a. RESOLUTION NO. 2017-65 REGARDING A REQUEST SUBMITTED BY NICHOLAS STANDAL AUTHORIZING APPROVAL OF A SIMPLE LAND DIVISION TO RE-ESTABLISH LOT 1 AND LOT 2, BLOCK 2, SONNENBERG'S ADDITION AS TWO SEPARATE TAX PARCELS (6145 & 6131 CAMDEN AVENUE N) Mr. Eitel provided background on Planning Commission Application No. 2017-003 and advised the Planning Commission recommended approval of the applications at its March 30, 2017, meeting. Councilmember Ryan moved and Councilmember Lawrence -Anderson seconded to adopt Resolution No. 2017-65 Regarding a Request Submitted by Nicholas Standal Authorizing Approval of a Simple Land Division to Re -Establish Lot 1 and Lot 2, Block 2, Sonnenberg's Addition as Two Separate Tax Parcels (6145 & 6131 Camden Avenue N). Motion passed unanimously. 10. COUNCIL CONSIDERATION ITEMS 10a. CONSIDERATION OF TYPE IV 6 -MONTH PROVISIONAL RENTAL LICENSES Mayor Willson explained the streamlined process that will now be used to consider Type IV 6 - Month Provisional Rental Licenses. Mayor Willson polled the audience and asked whether anyone was in attendance to provide testimony on any of the rental licenses as listed on tonight's meeting agenda. Seeing no one coming forward, Mayor Willson called for a motion on Agenda Items 10al through 100. 10al. 4200 WOODBINE LANE 10a2. RESOLUTION NO. 2017-66 APPROVING A TYPE IV RENTAL LICENSE FOR 6106 ALDRICH AVENUE NORTH 100. RESOLUTION NO. 2017-67 APPROVING A TYPE IV RENTAL LICENSE FOR 7048 FRANCE AVENUE NORTH Councilmember Lawrence -Anderson moved and Councilmember Ryan seconded to approve the issuance of a Type IV six-month provisional rental license and mitigation plan for the following: 4200 Woodbine Lane; adopt RESOLUTION NO. 2017-66 Approving a TYPE IV Rental License for 6106 Aldrich Avenue North; and, adopt RESOLUTION NO. 2017-67 Approving a Type IV Rental License for 7048 France Avenue North, with the requirement that the mitigation plans and all applicable ordinances must be strictly adhered to before renewal licenses would be considered. 04/24/17 -6- Motion passed unanimously. 10b. MAYORAL RATIFICATION OF FINANICAL COMMISSIONER Councilmember Ryan moved and Councilmember Graves seconded to ratify the Mayoral appointment of Tia Hedenland, 2613 65th Avenue North, to the Financial Commission with a term to expire December 31, 2017. Motion passed unanimously. Mayor Willson stated this vacancy was the last open seat, and it is nice to report that all of the City Commissions are now full. 10c. RESOLUTION NO. 2017-68 IN OPPOSITION TO H.F. 600 AND S.F. 580 REGARDING EXPRESS PREEMPTION; UNIFORMITY OF PRIVATE EMPLOYER MANDATES Mayor Willson stated the powers regarding preemption have been used to look at minimum wage, vacation time, and other items that are important to the working class people. He stated it is a right that cities currently have under local control decided upon by their City Council. He stated Brooklyn Center is providing a letter stating the City is in opposition to this legislation. Councilmember Ryan stated he feels it is very important to state their stance in opposition for this legislation. He stated the cities that have decided to set their minimum wage independently for their city, have done their due diligence to change those numbers and it is inappropriate for the legislation to take away those rights. He stated this item will take away sick time from working people and change the minimum wage to be uniform. Councilmember Ryan read the letter addressed to Legislators, stating the working class group of people deserve better than this and it is wrong for the Minnesota Legislature to take these rights away. Councilmember Graves moved and Councilmember Lawrence -Anderson seconded to adopt Resolution No. 2017-68 In Opposition to H.F. 600 and S.F. 580 Regarding Express Preemption; Uniformity of Private Employer Mandates. Motion passed unanimously. 11. COUNCIL REPORT Councilmember Ryan reported on his attendance at the following and provided information on the following upcoming events: • April 12, 2017: Attended MN Pollution Control Public Meeting • April 12, 2017: Attended the Area Residents 3 Street Trail Improvement Project Meeting • April 17, 2017: Attended Local Board of Appeal and Equalization Meeting 04/24/17 -7- • April 18, 2017: Attended 27th Annual Police Citizen Awards Event • April 20, 2017: Attended Annual Board Meeting Metro Cities in St. Paul • April 22, 2017: Attended the Watershed Great Shingle Creek Clean-up Event Councilmember Ryan stated he is very appreciative of the people who came out to help with the Watershed Clean-up event. He stated he would also like to mention it was his privilege to help with the Lions and Lioness Food Drive for CEAP and it is just one example of the great neighborhood they live in. He thanked Cub Foods and those who volunteered and donated towards the Drive. She noted, however, she managed to get her son and two of his friends to clean up the front yard and street as well as the backyard. Mayor Willson stated that would be great and noted the start time is at 7 a.m. 12.
