HomeMy WebLinkAbout2018-148 CCRMember Dan Ryan introduced the following resolution and moved its adoption: RESOLUTION NO. 2018-148 RESOLUTION AUTHORIZING PAYMENT OF SETTLEMENT AMOUNTS FOR EASEMENTS FOR BROOKLYN BOULEVARD CORRIDOR PROJECT PHASE 1, PROJECT NO. 2018-05 WHEREAS, the City of Brooklyn Center and Hennepin County have planned the improvement of Brooklyn Boulevard between 49th Avenue and 59"' Avenue within the City of Brooklyn Center, Minnesota in 2018 ("Project"); and WHEREAS, for the following 15 parcels, from which the City acquired permanent drainage, utility, sidewalk and trail easements and/or temporary construction easements necessary for the Project by the quick -take condemnation process, a memorandum of agreement on full compensation has been reached between the City of Brooklyn Center and each property owner; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 1 (PIN 10-118-21-14-0019) the sum of $24,400 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 3 (PIN 10-118-21-14-0017) the sum of $18,500 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 5 (PIN 10-118-21-14-0015) the sum of $22,000 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 6 (PIN 10-118-21-14-0012) the sum of $20,000 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 8 (PIN 10-118-21-14-0071) the sum of $20,529 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 9 (PIN 10-118-21-14-0070) the sum of $22,200 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 10 (PIN 10-118-21-14-0069) the sum of $19,900 for land and damages; and RESOLUTION NO. 2018-148 WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 11 (PIN 10-118-21-14-0068) the sum of $25,350 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 12 (PIN 10-118-21-14-0007) the sum of $23,200 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 20 (PIN 03-118-21-13-0092) the sum of $18,100 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 26 (PIN 10-118-21-14-0013) the sum of $8,800 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 33 (PIN 03-118-21-14-0033) the sum of $14,200 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 34 (PIN 03-118-21-13-0040) the sum of $6,300 for land and damages; and WHEREAS, for full compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 36 (PIN 03-118-21-44-0035) the sum of $39,245 for land and damages (with an additional $5,000 placed in escrow for potential irrigation damage costs); and WHEREAS, for fall compensation for the taking of said easements, the City of Brooklyn Center shall pay the owners of Parcel No. 37 (PIN 03-118-21-44-0036) the sum of $8,500 for land and damages (with an additional $2,500 placed in escrow for potential irrigation damage costs); and WHEREAS, said memoranda have been signed by the property owners and it is recommended that the City Council approve of them. RESOLUTION NO. 20416-448 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that 1. The City Manager is hereby authorized to execute the memoranda of agreement for the taking of permanent easements and temporary construction easements from Parcels 1, 3, 5, 6, 8, 9, 10, 11, 12, 20, 26, 33, 34, 36 and 37; and 2. The City Manager, City Attorney and City staff is hereby authorized to prepare and execute all documents necessary to obtain court approvals of these agreements and complete the condemnation action.
