HomeMy WebLinkAbout2018-161 CCRadoption: Member April Graves introduced the following resolution and moved its RESOLUTION NO. 2018-161 RESOLUTION TEMPORARILY SUSPENDING THE ISSUANCE OF NEW LICENSES FOR SALE OF TOBACCO OR TOBACCO RELATED PRODUCTS WHEREAS, the Brooklyns Youth Council ("BYC"), whose mission is to represent youth in Brooklyn Center by providing a voice in collaboration with the community and local government in order to positively raise awareness of problems facing youth, has performed a study on the effects of the availability of tobacco and tobacco -related products to young people; and WHEREAS, the City of Brooklyn Center ("City") is currently undertaking a study regarding the effect of raising the age limit for purchase and placing other restrictions on the availability and sale of tobacco and tobacco -related products; and WHEREAS, the City, as part of its study, requested input and recommendations from BYC, Hennepin County, and local businesses; and WHEREAS, the City Council has heard from the BYC, considered the information collected by City staff, and reviewed BYC's recommendations with regard to options for addressing tobacco -related concerns; and WHEREAS, the City Council has directed the preparation of an ordinance amending Sections 23-101 to 23-108 of the Brooklyn Center City Code ("Code") regarding tobacco and tobacco -related products; and WHEREAS, the City Council has determined it is in the public's best interest to temporarily suspend the issuance of new licenses authorizing the sale of tobacco and tobacco - related products while the ordinance amending the Code is considered, adopted, and goes into effect; and WHEREAS, the City has determined that effectuating said temporary suspension of the issuance of new licenses requires clear direction to the City manager. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1. The City Council hereby temporarily suspends the issuance of new licenses for sale of tobacco or tobacco -related products until such time as the ordinance amending Sections 23-101 to 23-108 of the Code is adopted and goes into effect. 2. The City manager shall direct City staff to not accept or process applications for new licenses for sale of tobacco or tobacco -related products during this temporary suspension. This temporary suspension does not affect the City's acceptance, processing, and issuance of applications to renew existing licenses for the sale of tobacco or tobacco -related products. 4. The suspension directed by this Resolution shall be in effect immediately, but shall not apply to any new applications received prior to the adoption of this Resolution. e September 10, 2018 �✓ ��°'���� Date Mayor City Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Marquita Butler and upon vote being taken thereon, the following voted in favor thereof: Tim Willson, Marquita Butler, April Graves, Kris Lawrence -Anderson and Dan Ryan and the following voted against the same: None whereupon said resolution was declared duly passed and adopted.
