HomeMy WebLinkAbout2019-014 CCRMember Ryan introduced the following resolution and moved its adoption: RESOLUTION NO. 2019-014 RESOLUTION VACATING ALL DRAINAGE AND UTILITY EASEMENTS WITHIN TOPGOLF ADDITION WHEREAS, certain existing easements are no longer needed on LOT 1, BLOCK 1, TOPGOLF ADDITION; and WHEREAS, the easements proposed to be vacated on the described properties are identified as follows (collectively, the "Easements"): Drainage and Utility Easements shown as located on LOT 1, BLOCK 1, TopGolf Addition; WHEREAS, after due notice and public hearing, the City Council has determined that the Easements will be no longer needed and it is in the public interest to vacate the Easements; and WHEREAS, the vacated Easements shall be official pending approval ofthe final plat by City Council and recording of the plat. NOW, THEREFORE, BE 'IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1. The City Council hereby approves the vacation of Easements described above and depicted in the attached Exhibit A conditioned on the approval and recording of the final plat for TopGolf 2nd Addition. 2. The City Clerk is directed to prepare a Notice of Completion of Vacation Proceedings and to record it with the Hennepin C m1y Recorder or Hennepin County Registrar of Titles, as approp ' January 28, 2019 Date Mayor 6 ATTEST: City Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Butler and upon vote being taken thereon, the following voted in favor thereof: Butler, Elliott, Graves, Lawrence -Anderson, Ryan and the following voted against the same: None whereupon said resolution was declared duly passed and adopted.
