HomeMy WebLinkAbout2019-062 CCRMember Ryan introduced the following resolution and moved its adoption: RESOLUTION NO. 2019-062 RESOLUTION ORDERING IMPROVEMENTS AND AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS FOR IMPROVEMENT PROJECT NOS. 2018-08 AND 2019-05, BELLVUE AND SOUTHEAST AREA MILL AND OVERLAY IMPROVEMENTS WHEREAS, the Brooklyn Center City Council on March 26, 2018 and June 11, 2018, authorized consideration of street and utility improvements in the area generally described as "Bellvue Neighborhood and Southeast Area', more specifically described as follows: 01 Street N from 55th Avenue N to Bellvue Lane; 54th Avenue N from 175' west of Irving Avenue N to Dupont Avenue N; 55t11 Avenue N from 175' west of Irving Avenue N to 4th Street N; 56th Avenue N from 175' west of Irving Avenue N to Interstate 94; Aldrich Avenue N from 56t11 Avenue N to 57th Avenue N; Bellvue Lane from 500' west of Camden Avenue N to 4th Street N; Bryant Avenue N fiom 53rd Avenue N to 57th Avenue N; Camden Avenue N from 53rd Avenue N to 57th Avenue N; Colfax Avenue N from 53rd Avenue N to 57th Avenue N; Dupont Avenue N from 53rd Avenue N to 57th Avenue N; Emerson Avenue N from 53rd Avenue N to 57th Avenue N; Fremont Avenue N from 53rd Avenue N to 57th Avenue N; Girard Avenue N from 53rd Avenue N to 57th Avenue N; and Irving Avenue N from 53rd Avenue N to 57t11 Avenue N; and WHEREAS, the City Council has received and accepted a feasibility report for said proposed improvements, as prepared under the City Engineer's supervision; and WHEREAS, said improvements are necessary, cost effective and feasible as detailed in the feasibility report; and WHEREAS, the City Council on March 11, 2019, adopted a resolution setting a date for a public hearing regarding the proposed improvements for Bellvue and Southeast Area; and WHEREAS, ten days published notice of public hearing was given and the public hearing was held on April 8, 2019, at which time all persons desiring to be heard were given the opportunity to be heard thereon; and WHEREAS, the City Council has considered all comments, testimony, evidence and reports offered at or prior to the April 8, 2019, public hearing; and WHEREAS, the City reasonably expects to spend monies from the Infrastructure Construction Fund on a temporary basis to pay the expenditures described in this resolution; and WHEREAS, the City reasonably expects to reimburse itself for such expenditures from the proceeds of taxable or tax-exempt bonds, the debt service of which is expected to be paid from property taxes, special assessments or utility fees. The maximum amount of special assessment obligations expected to be issued for such project is $911,379.74; and RESOLUTION NO. 2019-062 WHEREAS, the City Engineer is prepared to develop plans and specifications for said public improvement project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: Improvement Project Nos. 2018-08 and 2019-05, Bellvue and Southeast Area Mill and Overlay Improvements, are hereby ordered and the City Engineer is authorized to prepare plans and specifications for said improvements. 2. This resolution is intended to constitute official intent to issue taxable or tax exempt reimbursement bonds for purposes of Treasury Regulations and any successor law, regulation, or ruling. This resolution will be modified to the extent required or permitted by Treasury Regulations or any successor law, regulation, or ruling.
