HomeMy WebLinkAbout2019-079 CCRMember Ryan introduced the following resolution and moved its adoption: RESOLUTION NO. 2019-079 RESOLUTION APPROVING AMERICANS WITH DISABILITES ACT (ADA) TRANSTION PLAN- PUBLIC RIGHT-OF-WAY WHEREAS, the ADA was approved by the Federal Govermnent in 1992. These statutes prohibit public agencies from discriminating against persons with disabilities by excluding them from services, programs, or activities. These statutes require pedestrian access for persons with disabilities to an agency's right-of-way if pedestrian facilities exist; and WHEREAS, the Transition Plan encompasses several items which include a schedule for providing accessible features with the public right-of-way. The ADA Transition Plan contains the following four tasks: List of physical obstacles in the public agency's facilities that limit the accessibility of its programs or activities to individuals with disabilities, detail methods that will be used to male the facilities accessible, schedule for taking steps necessary to upgrade pedestrian access to meet ADA and Section 504 requirements in each year following the Transition Plan; and indicates the officials responsible for implementation of the Transition Plan; and WHEREAS, the City held a public comment period from April 1, 2019, through April 30, 2019, and has reviewed all comments and addressed them in the plan as warranted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1) The ADA Transition Plan — Public Rights -of -Way is hereby APPROVED. The motion for the adoption of the foregoing resolution was duly seconded by member Graves and upon vote being taken thereon, the following voted in favor thereof: Butler, Elliott, Graves, and Ryan and the following voted against the same: None whereupon said resolution was declared duly passed and adopted.
