its adoption:
RESOLUTION NO. 2019-103
RESOLUTION VACATING CERTAIN RIGHT-OF-WAY WITHIN THE
PLAT OF SWANCO TERRACE AND CERTAIN DRAINAGE AND UTILITY
EASEMENTS WITHIN THE PLAT OF EASTBROOK ESTATES
WHEREAS, the following described right-of-way, which is depicted on the attached
Exhibit A, is no longer needed:
All of 68th Avenue North as delineated and dedicated on SWANCO TERRACE,
according to the recorded plat thereof, Hennepin County, Minnesota.(the Subject
Right -of -Way"); and
WHEREAS, the following described drainage and utility easements, which are depicted on
the attached Exhibit B, are no longer needed:
All drainage and utility easements lying over, under and across Lots 2 and 3, Block 1, and
Outlot A, EASTBROOK ESTATES, according to the recorded plat thereof, Hennepin
County, Minnesota, as delineated and dedicated on said EASTBROOK ESTATES.(the
"Subject Easements"); and
WHEREAS, after due notice and a public hearing, the City Council has determined that
it is in the public interest to vacate the Subject Right -of -Way and the Subject Easements pursuant
to Minnesota Statutes, sections 412.851 and 462.358, subd. 7 ; and
WHEREAS; the vacations shall be conditioned on approval of the final plat of Eastbrook
Estates 2nd Addition by the City Council and the release of said final plat for recording.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center, Minnesota that:
1. The above recitals are hereby adopted as findings and incorporated into this
Resolution as if fully set forth herein.
2. The City Council hereby approves the vacation of the Subject Right -of -Way and the
Subject Easements, as described above and depicted on the attached exhibits, on
condition of the City Council's approval of the final plat of Eastbrook Estates 2nd
Addition and its release by the City for recording.
3. Upon the release for recording by the City of the final plat of Eastbrook Estates 2nd
Addition, the City Clerk is hereby authorized and directed to prepare and present to
the Hennepin County auditor a notice that the City has completed these vacation

proceedings. Said notice shall be recorded with the Hennepin County Recorder or the
Hennepin County Registrar of Titles, as appropriate, prior to the recording of the plat
of Eastbrook Estates 2nd Addition.

The motion for the adoption of the foregoing resolution was duly seconded by member Butler
and upon vote being taken thereon, the following voted in favor thereof: Butler, Elliott,
Graves, Lawrence -Anderson, and Ryan
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
