HomeMy WebLinkAbout2019 08-26 CCM Study SessionMINUTES OF THE PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA STUDY SESSION AUGUST 26, 2019 CITY HALL — COUNCIL CHAMBERS CALL TO ORDER The Brooklyn Center City Council met in Study Session called to order by Mayor Mike Elliott at 6:00 p.m. ROLL CALL Mayor Mike Elliott and Councilmembers Marquita Butler, April Graves, Kris Lawrence - Anderson, and Dan Ryan. Also present were City Manager Curt Boganey, Deputy City Manager Reggie Edwards, Public Works Director Doran Cote, Community Development Director Meg Beekman, Business and Workforce Development Coordinator Brett Angell, Police Chief Tim Gannon, City Attorney Troy Gilchrist, and Mary Mullen, TimeSaver Off Site Secretarial, Inc. CITY COUNCIL DISCUSSION OF AGENDA ITEMS AND QUESTIONS City Manager Curt Boganey requested that the following item be added to the Work Session Agenda: Item 6 — Discuss Mayor/City Council Office Mayor Elliott requested that Consent Agenda Item C, Local Water Supply Plan, be pulled for further discussion. Councilmember Lawrence -Anderson suggested that item be tabled and moved to a Work Session to give City Staff time for review. Mayor Elliott agreed. MISCELLANEOUS Councilmember Lawrence -Anderson stated, in place of National Night Out which was canceled due to inclement weather, a community event is scheduled for September 21, 2019, from 12:00- 1:30 p.m. in Centennial Park. She added the event would feature the Brooklyn Center Community Band in the amphitheater with hot dogs and burgers provided by the Lions. Mayor Elliott requested that Councilmember Lawrence -Anderson provide this information during the Council Update portion of the Agenda. Councilmember Lawrence -Anderson agreed. Councilmember Butler stated she received an email that was sent to all the Councilmembers from a representative of a group of Brooklyn Boulevard churches, including Cross of Glory. She added this group wants to get involved in the City's community engagement efforts and see if 08/26/19 4- they can help make an impact. She encouraged the City Councilmembers to respond to the email. Councilmember Butler stated there had been a lot of discussion about cleaning up the City, and efforts that City Staff are making toward improving the environment. She added she would like to address the City's impact on the environment at an upcoming Work Session and consider things the City can do by starting small, like eliminating plastic bags and straws at City Hall. Councilmember Lawrence -Anderson stated she was on Xerxes Avenue this past week and there was a large amount of trash on both sides of the road. DISCUSSION OF WORK SESSION AGENDA ITEMS AS TIME PERMITS DISCUSSION ON LEASING EDA -OWNED PROPERTY TO PRIVATE PARTIES AND FOOD TRUCK OPERATIONS WITHIN THE CITY Business and Workforce Development Coordinator Brett Angell stated there had been requests from local businesses to lease Economic Development Authority -owned property for use by private parties and food trucks. He added the City does not currently have a policy for this type of lease. He noted there are a few options that could be considered: prohibiting private events on EDA sites; create a City license process for specific types of uses, or EDA -approved licensing. He requested the City Council's feedback and comments on this issue, including what uses would be allowed, whether a fee would be charged, and what type of licensing process would be required. Councilmember Lawrence -Anderson stated liability is a concern. Mr. Angell stated there would be a regulatory process, under which the part that leases the property would need to provide proof of liability insurance. City Attorney Troy Gilchrist confirmed the liability issue could be handled through insurance indemnification requirements. Councilmember Graves stated she would support private events or functions. She added City Staff could provide recommendations for an appropriate licensing process, and potential fees, as well as give an idea of how much staff time would go into managing the process. She noted it would be a positive move to get some presence at the EDA -owned properties, and supports the strategic goals of economic stability, inclusion and connected community. Mayor Elliott stated he would support an EDA approval process, with guidance from staff regarding licensing criteria. Councilmember Ryan asked who would be responsible for clean-up and whether a licensing condition could be added for food truck operations for clean-up. 08/26/19 -2- Councilmember Lawrence -Anderson stated there should be a fee, as there will be staff time involved in the licensing process. She added City Staff could determine the appropriate fee. Mr. Angell stated City Staff could review similar policies in other communities and provide a draft policy that is based on the time would take to process the license. He added the interim use permit process might be appropriate if exterior storage will be prohibited. Mr. Angell stated there had been a lot of interest from food trucks who want to locate on private commercial property with approval from property owners. He added the City does not have an ordinance on food trucks. He noted the Hennepin County Health Department licenses and inspects food trucks. Mr. Angell reviewed options for allowing food trucks: continue a policy of not allowing food trucks; amend policy to allow food trucks with or without a permit or create a new ordinance related to food truck operations. He stated a written policy could include requirements about where they can and cannot be parked and incorporated into the Zoning Code. Mayor Elliott stated he likes the idea of having the option of food trucks. He stressed the importance of the environmental impact on the City, ensuring that food trucks clean up their location before they leave and whether they run a generator. Mr. Boganey questioned if a food truck policy is more feasible than an ordinance amendment. He added food trucks are currently allowed by administrative permit, per City Code, which can be modified. Mr. Gilchrist stated an important issue to consider is how the EDA allows its property to be used, and whether it will affect license agreements or other policies. He added this is best achieved through an ordinance to ensure its enforceability. Councilmember Lawrence -Anderson stated she supports a permit application process. Councilmember Graves asked what the requirements are for food trucks under the current administrative process. Mr. Angell stated it is a Special Use Permit process, with a maximum of 10 days. Councilmember Graves stated she supports it as it will be a good way to ensure that requirements and guidelines are in place. Mayor Elliott requested that City Staff provide more information and options for a potential ordinance. He added this issue should be expedited. Mr. Boganey requested City Council feedback on whether food trucks should be allowed in the public right of way. Mayor Elliott stated EDA -owned property is an appropriate place for this type of use. He added street parking of food trucks could be considered at a later date. 08/26/19 -3- Councilmember Ryan stated there would be safety concerns related to parking food trucks in the right of way. ORDINANCE AMENDMENT CHAPTER 11 LIQUOR Deputy City Manager Reggie Edwards reviewed a proposed amendment to Ordinance Chapter 11 related to liquor licenses, especially the 2:00 a.m. curfew. He added the recommendation is to move the liquor sales time from 2:00 a.m. to 1:00 a.m. Dr. Edwards reviewed data related to police calls at liquor establishments between 2018-2019. Discussion of this item will be continued in the August 26, 2019, Work Session.
