HomeMy WebLinkAbout2019-116 CCRMember Ryan adoption: introduced the following resolution and moved its RESOLUTION NO. 2019-116 RESOLUTION AMENDING THE CITY OF BROOKLYN CENTER FEE SCHEDULE RELATING TO LIQUOR LICENSE VIOLATIONS WHEREAS, the City Council is in the process of amending Chapter 11, Section 11-107 of the Brooklyn Center City Code regarding civil penalties that may be imposed for a liquor license violation and desires to establish the presumptive civil penalties that will apply for violations as indicated in ordinance amendment; and WHEREAS, these penalties are only presumptive and the City Council retains the discretion to establish different penalties based on its assessment of the particular circumstances related to the violation. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The liquor license fees within the City of Brooklyn Center Fee Schedule are hereby amended by adding a new section as follows: Liquor— Civil Penalties Offense* Civil Fine Suspension/Revocation First offense $500 None Second offense $1,000 One day suspension Third offense $1,500 Three days suspension Fourth offense $2,000 Five days suspension Fifth offense $2,000 Revocation * The number of violations shall be determined based on the history of violations for the preceding 24 -month period. 2. These presumptive civil penalties shall go into effect on the same date as the effective date of the ordinance amending City Code, Section l 1-107 regarding civil penalties.
