Three (3) copies of the following documents and information shall be submitted, at least 14 days prior to the date of the regular Commission meeting, concurrent with filing the appl c� ation required documents must be consistent with ordinance and policy provisions before an application may be accepted): 1. A certified site survey drawing by a registered engineer or land surveyor showing pertinent existing condition, accurately dimensioned. 2.* An accurately scaled and dimensioned site plan indicating: a) parking layouts including access provisions; b) designations and locations of accessory buildings; c) fences, walls or other screening, including heights and type of material; d) outside lighting provisions, type and location; e) curbing. 3.* A landscape plan showing areas to be sodded or seeded; location, size and species of trees and shrubbery. 4.* Building floor plans, elevations, sections and specifications, including materials proposed. 5.* Existing and proposed land elevations, drainage provisions, and utility provisions. 6. Additional drawings, plans or information deemed necessary by the Secretary. *Must be prepared by a registered architect or person registered with the State Board of Registration for Architects, Engineers and Land Surveyors, and said drawings/plans shall be so certified. NOTE: Upon approval of plans by the Council and prior to issuance of permits, a Performance Agreement as to approved site improvements and a supporting financial guarantee, in an amount to be determined by the City, are required. Acceptable financial instruments include cash escrow; certificate of deposit; and performance bond. Copies of the Zoning Ordinance may be obtained from the Administrative Office. P/I Form No. 19 Planning Commission Information Sheet Application No. 78035 Applicant: Mr. David Schak for Southland Corporation (7 Eleven Stores) Location: Northwest corner of 69th and Humboldt Avenues North Request: Special Use Site and Building Plan Approval The applicant seeks site and building plan approval for an approximate 2600 sq. ft. convenience food store and a special use permit for a proposed self-service gasoline facility. The property is zoned C-2 which comprehends both types of uses. A public hearing has been scheduled with respect to the special use permit request for the self-service gas facility. Attached is a sheet listing the ordinance standards for special use permits from Section 35-220 of the Zoning Ordinance. We have reviewed preliminary plans submitted by the applicant, have noted to the applicant various deficiencies thereon and have made several recommendations for improving the site layout. As of this writing, we have received revised plans which reflect deficiencies or generate concerns as noted belowc 1. The proposed gas pump island should be relocated further to the east since the proposed location, in our opinion, is too close to the 69th Avenue curb cut. The concern here is with potential stacking problem as well as traffic flow in and out of the site. 2. We recommend that additional 22 to 3 inch hardwood trees be provided especially in the south and east street side yard areas. There are trees indicated, but they are located to the rear of the site and the rear of the building. 3. We strongly recommend that berming be provided along the street yard areas to provide visual relief of the open parking on the site. 4. The indicated shrubbery at the intersection corner of the site should be substituted or redistributed since the type and height of plantings shown represent a sight obstruction at this corner. 5. The plans should indicate that the building is to be equipped with an automatic fire extinguishing system to meet NFPA Standard No. 13. 6. The minimum number of ordinance required parking spaces is 24; the submitted plan indicates 23 spaces, although there appears to be room for an additional space. The full compliment of minimum required parking should be clearly indicated on the plan with appropriate delineation. We will be informing the applicant of these concerns and requirements prior to the meeting, but will be prepared to inform the Commission in detail whether the applicant has responded with revisions. Application No. 78035 continued It is recommended that the Commission closely evaluate the proposed gasoline pumping facility in terms of the ordinance criteria for special use permits especially with respect to its proposed location. Conditions of approval would include at least the following: 1. Building plans are subject to review and approval by the Building Official with respect to applicable codes prior to issuance of permits. 2. Grading, drainage, utility and berming plans are subject to approval by the City Engineer prior to the issuance of permits. 3. A site Performance Agreement and financial guarantee (in an amount to be determined by the City Manager) shall be submitted prior to the issuance of permits to assure completion of approved improvements. 4. The special use permit is issued to the applicant as operator and is nontransferable. 5. The special use permit is subject to all applicable codes, ordinances, and regulations including special licensing requirements and violation thereof shall be grounds for revocation. 6. The building shall be equipped with an automatic fire extinguishing system as provided for in Chapter 5 of the City Ordinances. 7. Any rooftop mechanical equipment shall be appropriately screened from view. 8. Any outside trash disposal facilities shall be appropriately screened from view. 9. Plan approval is exclusive of all signery which is subject to Chapter 34 of the City Ordinances. 6-22-78
