The applicant proposes a 137,696 (151,465 with possible fixture mezzanine) square foot speculative bUlding on the southerly portion of the parcel now knoun as Outlot A (Earle Brown. Farm Apartments are located on the northerly portion of ©utlot B). Access would be from a cul--de-sac extension of 67th Avenue North. Requests Preliminary site and building plan approval We have been consulting with the applicants regarding two industrial structures to be located in the newly zoned 1-1 area. Submitted plans are being reviewed and concerns include: need for planned access provisions; appropriate landscaping and buffering; and the requirement for replatting the area. Location: moth of 60th Avenue, easterly of James Avenue North Request: Variance The request represents a portion of a pending site and building plan approval application, and is for two variances relative to buffer and setback requirements. 1) Section 35-413 provides that where a proposed i-1 development abuts an R-1 district at other than a street line, a pro- tective strip of at least.100 feet in width shall be provided. This strip shall be landscaped and shall not be used for parking, driving, storage, or loading. The strip must in-- c;ude an eight foot fence or wall approved by the Council The proposed development !Speculative Building No. 7) site is adjacent on the south to the :urge R-1 tract owned and partially occupied by the Eerean Evangelical. Free Church. The abutment is approximately 390 feet. The distance from the Spec. With respect to the standards for a variance: (a) a "hardship" is created on the basis that the 100 ft. buffer :is not necessary in this case and adequate buffering from the church open space is provided. (b) The conditions are unique to this parcel. (c) The alleged hardship is related to the requirement of the Ordinance and the established R-1 parcel so zoned be- cause of an existing special use. (d) Granting the variance is not deemed detrimental.; the church has indicated no objection. to the request. 2) Section 35--413 also provides that when a proposed 1--1 de- velopment. faces any residential use across a street, at least a 50 ft. wide buffer scrip shall be provided along said street. The strip stay not be used for any activity and must be landscaped. The proposed 1-1 development abuts an approximate 90 ft. length of a 30 ft. wide dedication of proposed Irving Avenue which extends southerly from 69th. The use on the other �. side is R-5; specifically parking and rear yards of apart - anent sites and vacant lots. The remaining approximate 790 ft. of the east boundary of they 1--1 site abuts R-5 directly. (Netably, when 1-1 abuts R-4 through R..7 at a property line, only the minimum 15 ft. buffer between the lot line and curblinee is required; whereas, when there is abutment at a street, a 50 ft. buffer is ro-- quuiJrW .) There is a 15 ft. greanstrip provided along this line. There is no foreseeable w arrant for installing Irving Avenue as dedicated, or for eiMending the dedicated portion to the South. A 50 ft. buffers for the approximate 90 ft. is not consistent with the requirerAtrnts for the remainder of the property. The situation is unique nand the hardship is related to ordianance requirements and the location of a 10 year old unneeded strce't dedication. Approval is in order subject to assurance thst substantial �- buffering--sc eening measures are taken. A public hearing has been scheduled.
