F; �$5,00 (Pd. 917"-) A "icant Ralph J.Luchsinger Data April 20, 1465 11 A G R E E M E N T WHEREAS, Ralph Luchsinger, hereinafter referred to as Luchsinger, has petitioned the Village of Brooklyn Center, Minnesota, hereinafter referred to as the Village, to rezone a portion of Lots 49 50 6, and 7. Block 1, Olson's Island View Terrace Addition to Brooklyn Center from R-1 to B-3; and WHEREAS, Luchsinger has also applied for a special use permit permitting the use of the property if rezoned as a gasoline filling station; and WHEREAS, the Village believes that a public right of way should be provided adjacent to the property for which rezoning has been requested; and WHEREAS, Luchsinger desires to assure the Village that he will dedicate the property required for public right of way, NOW, THEREFORE, IT IS AGREED that in consideration of the payment to him of one (1.00) dollar, receipt of which is hereby acknowledged, Luchsinger will convey to the Village within 60 days the following described property: A tract of land bounded on the west by Trunk Highway No. 169 and on the east by Willow Lane and more specifically described as: The south 25.0 feet of Lots 3 and 8. Block 1, Olson's Island View Terrace Addition to Brooklyn Center; and The north 25.0 feet of Lots 4 and 7. Block 1, Olson's Island View Terrace Addition to Brooklyn Center; except highway Provided, however, that Luchsinger's obligation to convey the above described property shall be conditioned upon his exercising his option to purchase the said property.
