In the original petition number V of that petition was incorrect in that certain numbers were transposed. Number V of the Petition should read as follows: V. In the requested shifting of boundary lines Anoka -Hennepin School District #11 would be giving Brooklyn Center School District #286 Parcel 4020 valued at $9000.00 and in exchange Brooklyn Center School District #286 would be giving Anoka -Hennepin School District #11 Parcel 8010 valued at $3000.00. TO: HENNEPIN COUNTY BOARD OF COMMISSIONERS, CLERK OF ANOKA SCHOOL DISTRICT #11, CLERK OF BROOKLYN CENTER SCHOOL DISTRICT #286, CLERK OF THE CITY OF BROOKLYN CENTER, AND THE HENNEPIN COUNTY AUDITOR. STATE OF MINNESOTA ) COUNTY OF ANOKA ) JAMES GILBERTSON, being duly sworn under oath, makes the following petition in support of his request to shift the boundaries of Anoka School District #11 and Brooklyn Center School District #286, in the area of 65th Avenue North and Willow Lane Drive, in the City of Brooklyn Center, County of Hennepin, State of Minnesota. I. This petitioner is the owner of that tract of land described as Lot 1, Block 1, Farr's 1st Addition, and has presented a preliminary plat to the City of Brooklyn Center for subdivision of .this property into five residential lots. II. The City of Brooklyn Center's Planning Commission and City Council have reviewed the preliminary plat, and conditionally approved said plat, if the boundary line between School District #11 and School District #286 is shifted to coincide with existing roads, property lines, and proposed property lines. At the present time the existing School District boundary line dissects an apartment complex on adjoin- ing land as well as lots in the proposed plat. At the present time Anoka -Hennepin School District #11 in the area of 65th Avenue North and Willow Lane consists of the following legally described property, to wit: "That part of Lot 16, Auditor's Subdivision 310, lying West of the following described line; Commencing at a point in the South line of Lot 16, lying a distance of 1164.60 feet East from the Southwest corner of Government Lot 2, Section 36, Township 119, Range 21, thence North 198.60 feet parallel with the Westerly line of Government Lot 2, thence east at right angles 232.30 feet, thence North 20 degrees 48 minutes West, 159.70 feet to North line of Lot 16 there terminating." Brooklyn Center School District #286 consists of all of the property lying East of the above described line. Attached hereto and incorporated herein is Exhibit A, which shows the line which was described in this paragraph. IV. Petitioner requests that a new School District boundary line be established, wherein Anoka -Hennepin School Distirct #11 consists of all the property lying West and North of the following described line: "Commencing at a point in the South line of Lot 16 lying a distance of 1164.60 feet East from the Southwest corner of Government Lot 2, Section 36, Township 119, Range 21, thence East on the South line of Lot 16 to the intersection of the centerline of Willow Lane Drive, thence North on the centerline of Willow Lane Drive to the intersection of the North line of Lot 16, Audior's Subdivision 310, thence East along the North line of Lot 16, Auditor's Subdivision 310 to the Mississippi River there terminating." Petitioner requests that Brooklyn Center School District #286 consists of all that property lying South and East of the line just described. The Line described herein is basically the centerline of 65th Avenue North to the intersection of Willow Lane Drive centerline, thence North on the centerline of Willow Lane Drive to the intersection of the Westerly extension of the North line of Block 1, Farr's 1st Addition (and the proposed Lot 1 of the same addition and block), thence Easterly along said Westerly extension of Block 1, Farr's 1st Addition, to Mississippi River there terminating. See Exhibit B attached hereto and incorporated herein which maps the proposed shift. 2. V. In the requested shifting of boundary lines Anoka -Hennepin School District #11 would be giving Brooklyn Center School District #286 Parcel 8010 valued at $3000.00 and in exchange Brooklyn Center School District #286 would be giving Anoka -Hennepin School District #11 Parcel 4020 valued at $9000.00. VI. Attached hereto and incorporated herein is petitioner's Exhibit C which is a letter from Brooklyn Center School District #286 Superintendent, Douglas M. Rossi, granting conditional approval of the petitioner's requested shifting of boundary lines. WHEREFORE, your petitioner prays for an Order of this Board shifting the present School District boundary between Anoka -Hennepin School District #11 and Brooklyn Center School District #286 in the manner proposed herein in order to conform to the existing roads, property boundaries and proposed property boundaries. Essentially, it appears that the owner of the property, Mr. James Gilbertson, wishes to sub -divide the land for potential homes and when meeting with the City regarding building permits, finds that our district lines dissect a portion of the property in question. It appears that the primary concern at this time is the hardship placed upon the builder due to the fact that the City does not feel a building permit can be issued until the potential problem regarding assessments, etc, can be straightened out. Since we have had other problems in the same area in the past (our line also divides an apartment unit in the same area) possibly both problems could be addressed and solved in one under- taking. It is my belief that we could work through Minnesota Statutes 122.21 relating to detachment and annexation of land. On Tuesday evening, September 30, 1975, our Board of Education went on record indicating a willingness to address itself to the entire issue and primarily to trade parcel #8010 for parcel *4020, which would in effect drop our school district line which runs east on 65th Avenue North to the middle of Willow Lane Drive, then travel north on Willow Lane to the north end of Parcel #4020 and follow the boundary line of that parcel east to the river. You will find our proposal drawn on the map enclosed. We believe this would. be a reascrable approach for both districts with neither losing a great deal of evaluation. 1Iore importantly, it would greatly clarify your southern and our northern b.-indary, keeping in mind the best interests of Mr. Gilbertson and the City.
