Hawthorne A "Special Use Permit" for the construction of 108 apartments on R. L. S. #838 was recommended by the Planning Commission on Dec. 4, 1958 and the "Special Use Permit" was approved by the Village Council on Dec. 9, 1958. Mr. Hawthorne took building permits for the construct on orthree of the apartment buildings on April 3, 1959, May 1, 1959, and Nov. 21, 1960. On Sept. 6, 1962 a public hearing was held for a "Special Use Permit" for apartments on Lots B,C,D,E,H,I and Jof R.L.S. 838 because the owner proposed to change the arrangement and type of apartment building from the plan originally approved. The Planning Commission recommended that the application be denied. On Sept. 10, 1962 the Village Council upheld the action of the Planning Commission and denied the application for the "Special Use Permit submitted Aug. 23, 1962. The Village Council also placed a "Hold Order" on the issuance of building permits on lots R. L. S. #838 until the Council had completed an investigation of a change in street layout and the traffic problem connected with the construction of apartment buildings in this area. , On Oct. 18 1962 the Council found that it was impossible to change the street layout and released the "Hold Order" authorized on Sept. 10, 1962. The Council then issued a new "Hold Order" on the same property until the Council had received a report from the Village Attorney concerning the possibility of changing lot area requirements from the construction of multiple dwellings under a "Special Use Permit" illued in 1958. �n Oct. 8, 1962 the Village Attorney rrepwtW to the Council that they may enforce the land area requirements of the ordinance but that they could not revoke the "Special Use Permit" for the construction of multiple dwelling. was. The action of the Council was to remove the "Hold Order" authorized Oct. 1, 1962 and instruct the building inspector to observe the land area ratio requirements in the issuance of the building permits on Tracts B,C,D,E,H, and I and further that Tract J must be deeded to the Village as public street. Discussions of this matter have brought out the following facts: 1. The computation of area requUreamts for the original "Special Use Permit: were in error because street area in the proposed plat were included in the area computatiwes. 2. The owner has not deeded to taw Village the west one half of Beard Ave. and the south one half of 45th Ave. as he had agreed to do. 3. The Village has in other instances issued "Special Use Permits" for a "Planned Development" of appartments without each building having a separate access to a public street. 4. If Tract j is retained by the owner and not required as a public street, there is a total area of 194, 628 sq. ft. in Lots B, C, D,E, H, I, and j excluding that portion of 65th Ave. in Lots B and C This would permit the construction of 72 apartments units on the above mentioned lots. 5. If the owner deeds to the Village the west one-half of Beard Ave. the lots on which the three existing buildings now stand will be substandard, having 26,460 sq. ft. instead of the required 30,200 sq. ft. The present buildings do have the ordinance required parking on the substandard lots. 6. Recent court decisions have established that the Village Council could not sustain an action to change the "Land Use" given under the 1958 "Special Use Permit". Based upon the above facts the Council proposes to allow the construction of 72 apartment units on Tracts B, C, D, E, H, I and j on the condition that the owner deed to the village the west one-half of Beard Ave. and the South one-half of 65th Ave. and further that the owner retain Tract j for driveway purposes and that tract j will not become a public street to be maintained by the village. The foregoing memo is written as iribrmation regarding past actions of the Village Council and notice of intentions of the village coundil to take furhter action at a Council meeting on March 25, 1963 at 7:30 P.
