Description of Request: The closing of this property is contingent upon the granting of a
special use permit to allow a private counseling practice on the premises The scheduled
date of closing is August 30 1989 This request does not involve a special home occupation
Section 35-406, but rather a home occupation as defined in Section 35-405.
The applicant requests processing of this application and agrees to pay to the City of
Brooklyn Center, within fifteen (15) days after mailing or delivery of the billing state-
ment, the actual costs incurred by the City for Engineering, Planning and Legal expenses
reasonably and necessarily required by the City for the processing of the application.
Such costs shall be in addition to the application fee described herein. Withdrawal of

PROCEDURES AND REQUIREMENTS FOR FILING APPLICATION FOR SITE AND BUILDING
PLAN APPROVAL
Prior to submission of an application for plan review and approval, prospective
applicants should arrange an informational meeting with the Planning Staff to discuss
preliminary plans and to become familiarized with applicable ordinance and policy
provisions.
Four (4) copies of the following documents and information shall be submitted, at least
14 days prior to the date of the regular Commission meeting, concurrent with filing the
application (required documents must be consistent with ordinance and policy provisions
before an application may be accepted):
1. A certified site survey drawing by a registered engineer or land surveyor
showing pertinent existing condition, accurately dimensioned.
2. *An accurately scaled and dimensioned site plan indicating:
a) parking layouts and access provisions, including calculation of
ordinance parking requirements;
b) designations and locations of all proposed buildings and required
setback lines;
c) fences, walls or other screening, including heights and type
of material;
d) outside lighting provisions, type and location (foot candle strength
at property line must be calculated);
e) curbing (B612 curb and gutter is required). Indicate radius measurements;
f) building information, including: gross floor area, type of construction
and occupancy classification.
3. *A landscape plan showing areas to be sodded or seeded, quantity, location,
size and species of trees and shrubbery. (Note: underground irrigation
is required in all landscaped areas in commercial and industrial districts.
Plans must be so noted).
4. *Building floor plans, elevations, sections and specifications, including
materials proposed.
5. *Existing and proposed land elevations, drainage provisions, and utility
provisions, including the diameters of utility lines.
6. Additional drawings, plans or information deemed necessary by the Secretary.
*Must be prepared by a registered architect or person registered with the State
Board of Registration for Architects, Engineers, Landscape Architects and Land
Surveyors, and said drawings/plans shall be so certified.
NOTE: Upon approval of plans by the Council and prior to issuance of permits, a
Performance Agreement as to approved site improvements and a supporting
financial guarantee, in an amount to be determined by the City, are required.
Acceptable financial instruments include cash escrow; certificate of deposit;
and performance bond.
Copies of the Zoning Ordinance may be obtained from the Administrative Office.

Request: Special Use Permit/Home Occupation
The applicant requests special use permit approval to conduct a counseling business
in the residence at 6941 Willow Lane. The property in question is zoned Rl and is
bounded on the east by Willow Lane, and on the south, west, and north by single-
family homes. Ms. Ladd does not yet occupy the home, but has a purchase agreement to
buy it, subject to receiving special use permit approval. The City has considered
home occupations involving customer traffic, such as a chiropractor's office or
psychological counseling business to be a special use in the R1 zone.
The applicant has submitted a letter ( attached) in which she describes the nature of
the business, her professional background, a description of the home office space,
and ability to comply with City ordinances. She states that she has maintained a
private counseling practice at 2445 Park Avenue South in Minneapolis since 1984.
Her clientele consists of persons seeking services for personal, relational, and
family concerns (72% individual counseling, 6% family counseling, and 20% marital
counseling). She states that she conducts her practice on an appointment only
basis and that her business hours are 8:30 a.m. to 5:30 p.m., Monday through Friday.
She states that she schedules an average of 4.5 meetings per day. She notes that her
clientele are, for the most part, professional persons addressing normal living
issues.
Regarding her professional background, Ms. Ladd states that she received her B.A. in
Social Work from the College of St. Catherine in 1974 and her Master of Social Work
from the University of Minnesota in 1983. She notes that she does some teaching in
addition to her counseling practice. She also points out that she is seeking a
license from the State of Minnesota as an Independent Clinical Social Worker and as a
Marriage and Family Counselor. Such licensing is a new requirement resulting from
legislation passed in 1988.
Ms. Ladd goes on to indicate that the space to be used for the home occupation is
presently an 18' x 24' family room with an adjoining 1/2 bath. Entrance to the room
is directly from the front door of the house. She expects no need for structural
alterations. Ms. Ladd also points out that there is a two car driveway and an extra
cobblestone parking area adjacent to the driveway. She adds that there will be no
equipment used other than normally found in the home; there will be no retail sales;
and no employment of other persons.
Staff see no problems with the proposed home occupation. A similar type of home
occupation was approved last year on O'Henry Road in the Central Neighborhood (Dean
Arnott, Application No. 88012, 3313 O'Henry Road, psychological counseling). We
believe the special use permit standards from Section 35-220 of the Zoning Ordinance
can be met in this case. The home occupation will not be detrimental to or endanger
the public health, safety, morals or comfort. It will not be injurious to other
property or substantially diminish property values in the neighborhood. The home
occupation will not impede the normal and orderly development and improvement of
surrounding property. Finally, adequate means exist for ingress, egress, and
parking so that there should be no traffic congestion in the public streets.

In general, the application appears to be in order and approval is recommended,
subject to at least the following conditions:
1. The special use permit is granted only for the specific use
proposed by the applicant. The use may not be altered or
expanded in any way without first securing an amendment to this
special use permit.
2. The special use permit is subject to all applicable codes
ordinances and regulations. Any violation, thereof, may be
grounds for revocation.
3. Special use permit approval acknowledges use of an 18' x 24' room
and adjoining half bath as being used for the home occupation.
This is deemed to be an incidental and secondary use of the
premises. No greater area within the home is acknowledged by
this permit.
4. Clients shall be served on an appointment only basis between the
hours of 8:30 a.m. and 5:30 p.m. Monday through Friday.
5. All parking associated with the home occupation shall be off-
street on improved space provided by the applicant.
6. The premises shall be inspected by the Building Official and any
necessary safety modifications required by him shall be
completed prior to the issuance of the special use permit.
7. A copy of the applicant's state license as an Independent
Clinical Social Worker shall be filed with the City Planning and
Inspection Department.

Dear Mr, Shallcross,
I am requesting the Brooklyn Center Planning Commission recommend the
issuance of a home occupation special use permit to be used at 6941
Willow Lane North, Brooklyn Center. My husband, Gary Bowman and myself,
signed a purchase agreement on this property July 15, 1989. The closing
date is contingent upon the granting of a special use permit.
Based on our July 14, 1989 phone conversation, it is my understanding
the Planning Commission requests the following information in order to
formulate a decision: A. Nature of Business B. Professional Background
C. Office Space Description D. Ability to Comply with City Ordinances
Section 35-220 SPECIAL USE PERMITS and Section 35-405 ADDITIONAL REQUIRE-
MENTS FOR HOME OCCUPATION. These concerns are addressed below.
A. NATURE OF BUSINESS
I have maintained a private counseling practice at 2445 Park Avenue South,
Minneapolis, Minnesota since 1984. My clientele consist of persons
seeking services for personal, relational and family concerns.

I conduct my practice on an appointment only basis. It is my intention to
continue this arrangement at 6941 Willow Lane. My business hours are
8:30 a.m. to 5:30 p.m. Monday thru Friday. On average,I schedule 4.5
meetings per day, My clientele are, for the most part, professional persons
addressing normal living issues.
B. PROFESSIONAL BACKGROUND
I was granted a Badhelor of Art degree in Social Work from the College
of St. Catherine, St. Paul in 1974. I received my Master of Social Work
degree from The University of Minnesota in 1983. I was employed as a family
counselor in a family crisis center from 1974-1984 at which time I began
my private practice. In addition to my counseling practice, I also teach
at The College of St. Catherine, am a national trainer/consultant for The
Johnson Institute and have provided professional consultation and training
for such organizations as The Minneapolis Y.M.C.A., Minneapolis Public
Schools and Fairview -Deaconess Hospital. My application for license in

the State of Minnesota as an Independent Clinical Social Worker and as
a Marriage and Family Counselor are currently being considered by the
newly formed Minnesota Board of Social Work and Marriage and Family
Therapy. This Board is a newly formed board as a result of legislation
passed in the 1988 legislative session. I am among the first professionals
in either of these disciplines to be able to apply for licensure in this
state.
C. DESCRIPTION OF HOME OFFICE SPACE
It is my intention to use the room designated as the family room for the
office space. This is a 24 x 18 foot room with an adjoining � bath.
Entrance to this room is very accessible as the front door opens directly
into this room. To operate my practice in this room, no alterations to
the existing home are required either interiorly or exteriorly. Access
to the room from the off-street parking area is direct.
D. ABILITY TO COMPLY WITH CITY ORDINANCES
The proposed home occupation will not alter the residential atmosphere
of the neighborhood. Clients will arrive and depart on an appointment
only basis. There is ample off-street parking in both the wide double car
driveway and on the extra cobblestone parking area adjacent to the driveway.
No equipment other than that customarily found in a residential dwelling
will be used. No retail sale of merchandise produced off the lot will be
involved. No employment of other persons will occur.
It is my hope that I have adequately addressed the necessary points. I
will be in contact with you as this process proceeds. The date of closing
is scheduled for August 30, 1989. Be assured I will assist you and the
Planning Commission in any way possible. I can be contacted at my office
