Variance for side yard setback
The applicant seeks to encroach 2 .feet upon a.five foot
utility easement at his eest property line to provide
proper setback for a planned garage.
He has contracted for the erection of the structure, assuming
there was no easement. He states a hardship would b realized
also because of the looation of the steps at the west side of
his home, in relation to the alignment of the driveway.
ANALYSIS AND RJECOMMEMDATIONS
The applicant has filed several reasons to support his request.
The circumstances, however, are not typical, relative to
setback requirements and variance needs.
The five foot area along the west property line is a formal
ut_llity easement; encroachment by any means would not be legal.
The relief mould be found only in a formal vac:atiag action by
the court.
Thus, the recommendation is for denial.
It appears the structure could be placed further to the north
and east, thus not requiring relief to build on the easement,
retaining the required setback area.
