PROCEDURES AND REQUIREMENTS FOR FILING APPLICATION FOR SITE AND BUILDING PLAN APPROVAL
Prior to submission of an application for plan review and approval, prospective
applicants should arrange an informational meeting with the Planning staff to discuss
preliminary plans and to become familiarized with applicable ordinance and policy
provisions.
Three (3) copies of the following documents and information shall be submitted, at
least 14 days prior to the date of the regular Commission meeting, concurrent with
filing the application (required documents must be consistent with ordinance and policy
provisions before an application may be accepted):
1. A certified site survey drawing by a registered engineer or land surveyor showing
pertinent existing condition, accurately dimensioned.
2.* An accurately scaled and dimensioned site plan indicating:
a) parking layouts including access provisions;
b) designations and locations of accessory buildings;
c) fences, walls or other screening, including heights and type of material;
d) outside lighting provisions, type and location;
e) curbing.
3.* A landscape plan showing areas to be sodded or seeded; location, size and species
of trees and shrubbery.
4.* Building floor plans, elevations, sections and specifications, including materials
proposed.
5,* Existing and proposed land elevations, drainage provisions, and utility provisions..
6� Additional drawings, plans or information deemed necessary by the Secretary.
*Must be prepared by a registered architect or person registered with the State Board
of Registration for Architects, Engineers and Land Surveyors, and said drawings/plans
shall be so certified.
NOTE: Upon approval of plans by the Council and prior to issuance of permits, a
Performance Agreement as to approved site improvements and a supporting financial
guarantee, in an amount to be determined by the City, are required. Acceptable
financial instruments include cash escrow; certificate of deposit; and performance
bond,
Copies of the Zoning Ordinance may be obtained from the Administrative Office.

Request: Variance
The applicant seeks a variance to permit a 14 x 20 foot addition to an existing
14 x 20 foot garage located at the rear of his property. The premises is approxi-
inately 300 feet deep and contains a 1,076 sq.ft. dwelling, a 14 x 18 foot tuck -under
garage and a 10 x 12 porch/patio attached to the dwelling.
The numt;er of accessory buildings (3) exceeds the ord-; nance maximum of two. I .'he total
area, including the proposed addition; is within the ordinance standards, however.
The applicant contends the additional garage space is needed for storage and repair
of equipment related to his landscape business which tie has operated from the premises
since 1953.
The zoning of this unusually deep lot was once industrial and it abuts the Soo Line
Railroad right--of-way. Apparently, the "home occupation" business was established
under the Industrial Zoning which was changed to R-1 by the present ordinance in 1963.
All of the structures were built before then.
The applicant has access to the rear of his property ---where the landscape equipment
is stored ---over the Soo Line property via a private cross -easement. In addition to
the 14 x 20 ft. garage, there is a private gasoline pump in the rear area.
While there appears to be merit to the specific request ---giver. the unique size of
the parcel; the location of the land and the garage on the lot; and the remoteness
of the use from neighboring dwellings ---there is a question as to the status of the
activity generating the need for the garage.
The business is a valid "nonconforming" special use permitted under a former ordinance;
however, whether it would be approved today as ati R-1 special home occupation with
extraordinary equipment and fuel storage is of concern, since the proposed structure
is an enhancement of that use.
The size of the lot, the location of the use on the lot, and the abutment of the lot
to a heavy industrial area would lend credence to the use. This could include the
gasoline facility, provided it was approved by the Fire Marshall and licensed..
If the use is deemed acceptable, there would be merit in the request to provide
storage for the equipment by adding onto the garage.
Reaffirmation of the use would be subject to the following:
1. There shall be no vehicular access related to the landscape business
from 49th Avenue.

2. Evidence of current cross easement to the ►^czar of the parcel shall
be kept or file with the City.
3. Fuel storage facilities shall be inspected! and 'licensed according
to the requirements of Chapter 23.
4. All equipment and vehicles related to the landscape bu0 ness shall
be stored in the garage or screened from view of neighboring properties,
at the rear of the property,
A public hearing has been scheduled.
