The proposed plat would subdivide the property into two single family residential lots. The property has radical elevation characteristics which require thorough analysis as to proper engineering improvements which would be required before it could be developed. It is our understanding that the property has never been built upon because of these physical characteristics, and until recently, the property was held by the State since it had gone tax -forfeit. The applicant submitted a basic preliminary plat which lacked a number of in- formational items required by the Subdivision Ordinance and by the City Engineer. He was informed that, because of the advanced publication requirements for a notice of this meeting, we would accept the application with the express under- standing that the additional required data would be submitted and reviewed prior to the meeting. At this writing, such additional data has not been submitted. A notice of public hearing was published in the newspaper, and in addition, because of the characteristics of this parcel, we initiated notices of the hearing to immediate neighboring property owners. If the required data and analysis have not been accomplished by the meeting, as determined by the City Engineer, it is our recommendation that this item be tabled until the same can be accomplished. Should the information be supplied, and a proper analysis provided, approval would be subject to the following conditions: 1. Final plat is subject to approval by the City Engineer. 2. It is the claim of Patrick F. and Gina M. Fogerty that the i Brooklyn Center City Council at its meeting of February 27, 1978, by its approval of Planning Catmission Application #78003, which created a ponding ease- ; r meet over approximately 150 feet of the stated property, did negligently fail to provide adequate drainage for the property, as required by Brooklyn Center { City Ordinances. That because of the negligence of the City of Brooklyn a Center, water collected on the property of Patrick F. and Gina M. Fogerty following spring rains, that although Patrick F. and Gina M. Fogerty obtained a .a pump and pumped the water from their property, the property remained dry for only one day, and that the standing water on the stated property has failed to drain from the property, and a pond has remained on the stated property since that time. As a result, Patrick F. and Gina M. Fogerty sustained damage to their property in the form of a reduction in the value of. their property, the total depre- vation of the right to use and enjoy that portion of their property which is covered by standing water, the creation of serious health hazards due to the existence of standing water in close proximity to their home, and the creation of a serious safety hazard on their property which endangers Patrick F. and Gina M.
