Re: Restoration of Screening Device at 2105 57th Avenue North
Dear Ms. Olson,
This letter is to inform you in writing that the screening device
(a 4' high chain link fence and tall shrubs) which was removed from
the property at 2105 57th Avenue North last fall is a required
screening device under the City's Zoning Ordinance and must be
replaced as soon as weather permits. Section 35-412, Subsection 3
of the City's Zoning Ordinance (copy attached) requires an 8' high
opaque fence or wall where a C2 use abuts R1, R2, or R3 zoned
property other than at a street line. There are R1 zoned
properties immediately south of the commercial property at 2105
57th Avenue North and, therefore, a screening device is required.
A City Council approved substitute is acceptable. I informed you
last fall that replacing the previous 4' high chain link fence and
shrubs with the same treatment or with an 8' high opaque fence or
wall would be acceptable under the Zoning Ordinance. I discussed
this requirement with your husband and with a fence contractor in
late October of last year; however, no screening device has been
installed.
You are hereby ordered to restore a proper opaque screening device
to the commercial property at 2105 57th Avenue North. You may
either erect an 8' high opaque, wood fence or you may replace the
Council approved screening that previously existed - a 4' high
chain link fence and tall -growing shrubs. A chain link fence with
slats is not acceptable. This work must be completed by May 15,
1992 or I will recommend to the Director of Planning and Inspection
that the City prosecute the matter as a zoning violation.

MEMORANDUM
TO: Gerald Splinter, City Manager

DATE: October 22, 1991
SUBJECT: Warner Hardware Screening
Approximately a month ago, I got a call from a neighbor to the
south of the old Warner Hardware building complaining that someone
had torn out the fence and shrubs along the south side of the
Warners property that used to screen the site (the parking lot)
from the residences. I looked up the owner and talked with Mrs.
Doris Boyum, informing her that the screening treatment which had
just been torn out was required by City ordinance (sections 35-412
and 35-711). She agreed to replace the screening treatment with
something comparable. I believe I later talked to her husband
about the screening treatment and told him that if they used a wood
fence, it should be 8' high as required by section 35-412. I told
him, however, that I would accept a chain link fence and shrubs as
had apparently been the Council approved screening treatment.
I received another call from the neighbor to the south yesterday
(October 21, 1991) informing me that nothing had been done. I told
him I would follow up. Coincidently, that same morning, Mrs. Boyum
and a gentleman with her (I think her husband) came in to discuss
the fencing and the shrubs that they planned to put in next week.
I approved putting in the same screening treatment as had been
removed and they left, I believe, with that understanding. I noted
my approval on a fence contract form they showed me to illustrate
what they would do. I told them that a neighbor (whom I did not
identify) had expressed concern and encouraged them to complete the
work as soon as possible. The gentlemen indicated they would get
it done next week (10-28 to 11-1). They pointed out that some of
the neighbors already have fences and shrubs. I explained to them,
however, that the burden of providing the screening was on the
commercial property, not the residential.
