The Pure Oil Company is requesting a special use permit for a nasoline
service station on the South side of S% Aire. between Mason's berber shop and
Warner Hardware.
The property now being used for a service station at 57th Avenue: and
Hwy, 3100 will be acquired by the State of Minnesota for highway expansion and
access will be restricted, therefor the oil company wishes to relocate the
station as near the present site as possible,
The proposed building site is zoned B-1 which permits service stations
by special permit providing they do not abut a lot in an R--1 or R-B district.
The proposed site adjoins 5-1 Districts on the East and West sides and abuts
a platted R-•1 district on the rear or South,
Section 35-412 of the Village Ordinances establishes minimum require-
ments for the development of new neighborhood shopping centers and states
that the requirements shall also apply to future commercial development in
areas already zoned for neighborhood business (B-1 Districts.) Strict
enforcement of this section would preclude any commercial development (in B-1
Districts) that did not contain a retail grocery store and a drug store and
have 25,000 square feet of gross floor area,,
Compliance with Section 35--412 would locate a new neighborhood
shopping center adjacent to Northbrook Center which would be inconsistent
with the intent of the ordinance as indicated in the first paragraph of the
section.
The question then is should the station be relocated within the same
general customer area where they have an established business and can the
proposed location be considered for individual commercial businesses
which are local in nature and serve the residential neighborhood.
The total area could possibly be considered as a local business
district with Northbrook Shopping Center being the principle commercial
activity with individually owned stores, shops and neighborhood service
facilities surrounding the center, If this concept is reasonable then a
variance on Section 35-412 (2), which requires the area to be platted as a
single parcel of land under unified control, would be necessary.
