LAND USE PERMIT
KNOW ALL MEN BY THESE PRESENTS: That NORTHERN STATES POSTER COMPANY,
a Minnesota corporation, hereinafter c "Grantor," in consideration of the
sum of One Dollar ($1.00) and other good and valuable consideration to it in
hand paid by Donald D. Mason , hereinafter called "Grantee,"
the receipt and sufficiency whereof is hereby acknowledged, does hereby grant
unto Grantee permission to use the following described real estate owned by
Grantor in the County of Hennepin, State of Minnesota, to -wit:
The East Sixty (60) feet of the West Ninety-three (93)
feet of the North Seventy (70) feet of Lot Fifty-five (55),
Auditor's Subdivision No. Two Hundred Eighteen (218).
for auto parking purposes exclusively.
This permit shall become effective on July 1, 1963, and shall continue
until terminated by the Grantee or revoked by the Grantor. Until so terminated
or revoked, Grantee shall also pay to Grantor:
1) ^:s rental from the effective date hereof to the end of the current
calendar year $25.00, payable forthwith.
2) As rental thereafter $50.00 per annum, plus an annual amount equal to
any increase in taxes over and above the taxes assessed against said
property for the year 1962 (payable in 1963), plus 12.1% of the
principal amount of any special assessments levied against said
property subsequent to the effective date hereof, all payable on
or before the first day of February in each calendar year.
This permit may be terminated by the Grantee at the end of any calendar
year by giving at least 30 days' prior notice in writing of such termination, and
may be revoked at any time by the Grantor, with or without cause, by giving at
least six months' prior notice in writing of such revocation and returning any
prepaid rent covering the period beyond the effective date of such revocation.
Upon the termination or revocation of this permit, Grantee shall restore
or regrade the above described property to a condition satisfactory to Grantor.
Grantee, in the use of the property, shall comply with all pertinent
laws, codes, and ordinances and shall install an approved fence or hedge along
the South and East sides of the above deed tract.
Nothing herein contained sha11 be deemed to restrict in any way the
continued use of the said property by Grantor for the construction, operation,
or maintenance of its electric transmission or distribution lines and appurtenant
facilities located or to be located thereon, or with other uses of the land not
inconsistent with the right herein granted.
