Subject: City Council Consideration Item - Planning Commission Application No. 2005-003

On the February 28, 2005 City Council Agenda is Planning Commission Application No. 2005-003 submitted by Mr. William J. Tippmann on behalf of Bear Creek Capital, LLC requesting Rezoning
from R-1 and C-1 to PUD/C-2 and development plan approval through the Planned Unit Development (PUD) process for a 13,000 sq. ft. CVS Pharmacy on a proposed 1.53 acre site located at
the northwest corner of County Road 10 and Brooklyn Boulevard.
Attached for your review are copies of the Planning Commission Information Sheet for Planning Commission Application No. 2005-003 and also an area map showing the location of the property
under consideration, various site and building plans for the proposed development, the Planning Commission minutes relating to the Commission's consideration of this matter and other
supporting documents.
This matter was considered by the Planning Commission at their February 17, 2005 meeting and was recommended for approval through Planning Commission Resolution No. 2005-01 (attached).
It is recommended that the City Council, following consideration of this matter, approve the application subject to the conditions recommended by the Planning Commission. A resolution
outlining the history of the application along with findings and conditions of approval is offered for the City Council’s consideration.
Also, an ordinance amendment redescribing the property to be rezoned within this Planned Unit Development is offered for first reading by the City Council. The new description contained
in the plat will be used for the ordinance amendment. The final plat will have to be approved and filed before the description can be utilized.
It is recommended that the City Council adopt the draft resolution and, by motion, approve the first reading of the ordinance amendment describing the property to be rezoned.
