Refer to the information sheet and minutes for the December 2, 1976 meeting.
The item was submitted as a request for variances to permit division by metes
and bounds description, and to create a substandard R-1 lot. It was tabled to
allow an opportunity to determine whether a standard size lot could be created
through formal replatting.
We have reviewed the layout of the parcels and have determined that an interior
lot, consistent with ordinance standards, can be designed. The configuration
is unorthodox in that a side lot line is "boxed" around the projected dwelling
which encroaches 6 feet into the existing lot.
The applicant has indicated a preference for a less cumbersome layout; however,
more orthodox rectangular designs result in substandard dimensions.
We also determined the original house is only 7'8" from the original lot line.
The Subdivision Ordinance lists the following standards for a variance:
1 . That there are special circumstances or conditions affecting
said property such that the strict application of the pro-
visions of this ordinance would deprive the applicant of the
reasonable use of his land.
2. That the variance is necessary for the preservation and
enjoyment of a substantial property right of the petitioner.
3. That the granting of the variance will not be detrimental to
the public welfare or injurious to other property in the
territory in which said property is situated.
We will have graphics and information on the alternative platting.
Recommended conditions for a replat of the land would be:
1 . Final plat is subject to review by the City Engineer.
2. Final plat is subject to the requirements of Chapter 15
of the City Ordinances.
Any variance action should be specific as to findings related to the ordinance
standards.
