C. d. e. f. g. house - 905 square feet garage (including lean-to) - 400 square feet summer house - 96 square feet play house - 48 square feet tool house - 64 square feet concrete block structure - 148 replaced by garage addition) dog house - 27 square feet POINTS TO BE CONSIDERED: square feet ( to be 1) The R-1 zoning regulations list the following as a permitted use: "Private garages used in connection with single family dwelling units and not for commercial purposes, containing not more than 660 square feet of floor area.". 2) The applicant proposes to add a roofed -over structure to the side of his existing garage, and a 2 foot extension to the front of it, bringing the total square footage of the garage structure to 620 square feet. Although this area in itself is not in excess of 660 square feet, the Staff considered that the :interpretation of this area maximum left room for doubt as to whether the square footage should include the total area of all the outbuildings on the property, especially in light of previous concerns stated by the Commission arid. Council relating to limiting the number of accessory buildings to be permitted on residential properties. The Commission, in fact, had examined a related question with a previous Application for an oversized garage/patio, and had reached a consensus that "no accessory building shall. L exceed 75% of the area of the primary building, and the total area of accessory buildings shall not exceed 100% of the :door area of the primary building". Following this statement of intent, and expanding upon it in accord with the Commission's later comments relating to the proliferation of outbuildings in residential areas, the Staff elaborated on the concept for possible inclusion in the Zoning Ordinance, resulting in the following provision: "One accessory building up to 660 square feet in area where the primary building ground coverage area does not exceed 880 square feet. In the event that ground coverage area of the primary building exceeds 880 square feet, two accessory buildings will be permitted, provided that no one accessory building shall exceed 75% of the ground coverage area of the primary building, and provided that the total area of both accessory buildings shall not exceed 1000/a of the ground coverage area of the primary buildings". Thus, to reiterate, the Staff had not to this time encountered a situation such as this one with a proliferation of accessory buildings on a single family residential property, and in view of past pronouncements by the Commission and Council on this subject, felt the only proper way to handle the situation was by review of the Commission and Council in the form of a variance request. 2) If the variance is to be granted to Mr. Strong, it should be made clear that the present garage structure has been inspected and found to be nonconforming in respect to applicable building codes, and that the entire structure will have to conform to building codes upon completion. The matter of the building being nonconforming as to setback from the property line is probably not material in this application, as the setback from the east property line will be unchanged by the proposed construction. u• North O 4 r* at a i h 1, rred Strong, owner of the property at 516-62nd Avenue North, hereby agree to accomplish the following, in accordance with the variance granted to ice by the City Council on September 18, 1967: 1. 1 shall, within 90 days of the completion of the garage not exceeding 600 square feet in area, remove from my property the 27 squire foot dog house and the 148 square foot concrete block structure. 2. 1 shall construct the garage in bonformanee with the Building Codes of the City of Brooklyn Center. Following is an excerpt from the minutes of the City Council meeting of September 17, 1967. "The Council then considered Application 067049 sub- mitted by Mr. and Mrs. Fred Strong, requesting a variance from Section 35-310 to permit construction of an addition to an existing garage which would cause the total square footage of accessory buildings on the property at 516 - 62nd Avenue North to exceed the 660 square feet permitted. Mr. and Mrs. Strong were present to discuss the Application with the Council, explaining that they plan to remove two of the buildings presently on the property following the alterations of the garage, so that the total square footage of the garage would be 600 square feet and the total area of all accessory buildings on the property would be approxi- mately 808 square feet. Following discussion of the appli- cation by the Council the following action was tam. Motion by Theodore Willard and seconded by Gordon Erickson to approve the variance request contained in Appli- cation #67049 for the property at 516 - 62nd Avenue North to permit alterations and additional construction to the existing garage to be made, to bring the total area of the garage to 600 square feett however, because of the number of buildings on the property, the variance approval is contingent upon the applicant agreeing to the following conditioner in writings 1. The concrete block structure containing 148 square feet and the 27 square foot dog house shall be removed within 90 days of completion of construction of the garages Fred Strong -2- October S, 1967 2.
