Type of Request: Variance from Section 35-401 to allow construction of a
garage three feet from the street right-of-way, vithin
the required front yard setback.
Baekground.
1) 'Phis request involves the problem encountered with parcels of
land abutting uatorcoarses where the occupants have chosen to
consider their shore property as their front yard, in contrast
to the usual definition as laid out to our ordinance. This
property and adjacent ones have been allowed by the Vi l l age
to consider their property as having froutage on the lake.
Polots to be Considered
1) The presence of the utilities easement in the "ff on "yard of
the applicant restricts his choice of positiOns for 02
garage in what he considershi:s "back." yard.
Staff COMMOUts:
1) The applicent should explain why he cannot build his garage
elsewhere on his lot, particularly along the soutb lor, line
to tho hest of the easement. Allowing hits to build as close
to the street as he requests is probably not a necessity.
