PIX1CIDURES AND REQUIREMENTS FOR FILING APPLICATION FOR SITE AND BUILDING
PLAN APPROVAL
Prior to submission of an application for plan review and approval, prospective
applicants should arrange an informational meeting with the Planning Staff to
discuss preliminary plans and to become familiarized with applicable ordinance
and policy provisions.
Three (3) copies of the following documents and information shall be submitted,
at least 14 days prior to the data of the regular Commission meeting, concurrent
v:i`h filing the application (required documents must be consistent with ordi-
nance and policy provisions before an application may be accepted):
1. A certified site survey drawing by a registered engineer or land surveyor
showing pertinent existing condition, accurately dimensioned.
2.* An accurately scaled and dimensioned site plan indicating:-."
a) parking layouts including access provisions __.
b) designations and locations of accessory buildings;
c) fences, walls or other screening, including heights and type of material;
d) outside lighting provisions, type and location;
e) curbing.
3.* A Landscape plan showing areas to be sodded or seeded location, size and -
species of trees and shrubbery.
4.* Building floor plans, elevations, sections and specifications, including
materials proposed.
5.* Existing and proposed land elevations, drainage provisions, and utility
provisions.
6. Additional drawings, plans or information deemed necessary by the Secretary..
*Must be prepared by a registered architect or parson registered with the State
.Board of Regist-ration for Architects, Engineers and Land Surveyors, and said
drG,aings/plans shall be so certified.
NOTE: Upon approval of plans by the Council and prior to issuance of permits,
a Performance Agreement as to approved site improvements and a supporting finan-
cial guarantee, in an amount to be determined by the City, are required. Accept-
able financial instruments include cash escrow; certificate of deposit; and
performance bond.
Copies of the Zoning Ordinance may be obtained from the Administrative Office.

Request: Home Occupation - Special Use Permit
The applicant requests special use permit approval to conduct a part-time welding
operation in the garage at 4800 - 71st Avenue North. The property in question is
zoned R1 and is surrounded by single-family homes to the west, the Creek Villas
Townhouses to the north, Brooklyn Boulevard to the east, and 71st Avenue North
and vacant R2 zoned land to the south.
The applicant has submitted a letter (attached) in which he provides pertinent
information regarding the proposed home occupation. Mr. Johnston's work will
include building steps for mobile homes, novelty door knockers and other small
jobs. He also has a portable welder in his pickup truck which he uses to weld
items at a customer's location. The hours of operation are proposed to be 5:00
to 9:00 p.m., evenings and "weekends only. Approximately 4 to 5 hours a week."
Mr. Johnston also states that the noise level from the welding is considerably
less than the traffic noise from Brooklyn Boulevard.

The Building Official inspected the premises on June 19, 1981 and
that there are two fire extinguishers in the garage where the home
to be located and a proper fire wall to the dwelling. The Building
states that no substantial quantities of gasoline may be stored in
of the welder as required by the Fire Code.
The applicant has one 10" x 36" illuminated sign on.a,post at the edge of his
driveway.
There is one other part-time welding home occupation approved in the City at
5339 Logan Avenue North for Mr. Harry Tiefs. That approval provided that there
should be no outside storage of materials and that the home occupation would be
active only during daylight hours. Whether the current use should be restricted
to daylight hours is perhaps a matter for discussion. However, Mr. Johnston
works during the day. Therefore, eliminating evening hours for the home occupation
might well create a hardship for the applicant. Another consideration is that
the noise level from Brooklyn Boulevard certainly exceeds that on Logan Avenue
North which is a residential street. Mr. Johnston has contacted some neighboring
property owners who apparently have no objection to the use as long as it is
only part-time.
Staff's recommendation is that the proposed use does, in fact, qualify under the
Zoning Ordinance as a Special Home Occupation. Approval, however, should be
subject to at least the following conditions:
1. The permit is issued to the applicant as operator of the home
occupation and is nontransferable.
2. The permit is subject to all applicable codes, ordinances,
and regulations, and any violation thereof shall be grounds for
revocation.
3. The hours of operation shall be:

4. Noise from the operation shall not be perceptible beyond the
premises on which it is located.
5. All parking associated with the home occupation shall be off-
street on improved space provided by the applicant.
6. The home occupation shall not occupy an area more than one-half
of the area of the structure in which it is located.
7. The home occupation shall conform with the recommendations of
the Building Official prior to the issuance of the special use
permit.
8. Signery related to the home occupation is subject to the provisions
of the Sign Ordinance.
9. Service or repair of automotive vehicles on the property where the
home occupation is conducted is strictly prohibited as per Section
35-900 (definition of private garage) of the City's Zoning Ordinance.
10. There shall be no outside storage of materials related to the
home occupation.
