Sheehy, Jr., Vice President Brooklyn Center Development Corporation 6100 Summit Drive North Brooklyn Center, Minnesota 55430 Dear Mr. Sheehy: I wish to take this opportunity to acknowledge your letter of December 11, 1972 relative to your intention to install a sprinkler system in the proposed 236 project on Shingle Creek Parkway. I interpret the letter to confirm our conversation of December 11, 1972 during which it was agreed that you will proceed to secure sprinkler system design alternatives and associated costs with the intention of installing a sprinkler system in the proposed building, if the project is approved by the City Council. It is understood that if the cost of an adequate sprinkler system makes the project economically unsound and HUD refuses to make necessary rent adjustments, the project will be canceled. Thank you. Poss, City Manager Brooklyn Center City Hall 6301 Shingle Creek Parkway Brooklyn Center, Minnesota 55430 Dear Mr. Poss; There has been a great deal of discussion between federal officials, you and city officials, our architects and ourselves on the question of sprink- lers in the 13-story 236 project on Shingle Creek Parkway. The present State Building Code does not require sprinkler systems on this type of con- struction, but we are aware of the interest of the Brooklyn Center public officials in making this a safe building. It would appear that some compromise can be developed between the present code and the emerging needs for public safety. We are willing to meet with the proper officials in all levels of government concerned with this project, our architects, the Fire Underwriters Bureau and anyone else necessary to design a sprinkler system which would satisfy all parties. We would like to continue processing the project through the Plan- ning Commission and City Council. We agree to bring in sprinkler design and costs for discussion. If the additional costs make the project econi- cally unsound and additional funds are not available to cover the increased costs, then the project will be cancelled. Poss, City Manager SUBJECT: Brooklyn Center Development Corporation "236" Project DATE: December 7, 1972 I have had an opportunity to review the December 6 letter submitted by Mr. C. E. Sheehy, Jr. regarding our concern that a sprinkler system be Installed in their proposed 13-story 236 housing project. Had the letter stopped at the end of the second paragraph, I could have accepted the statement as a definite intent to install the sprinkler system and so advise the Planning Commission. However, the last paragraph of the December 6 letter from Mr. Sheehy, a s well a s a letter dated December 5, 1972 from HUD Area Director Thomas Feeney, suggests to me an effort to qualify the statement of commitment or the actual sprinkler plans which we are seeking. You may advise the applicant that we will accept their offer in their December 6 letter to meet with theca as necessary to develop date upon which they may make a definite decision of commitment. Assuming that this can be completed posthaste and that the commitment is forthcoming, are will reschedule them for an appearance before the Planning Commission on December 14, 1972. Our problem, as you are probably aware, is the long lead time in this project. We have been working on this hi -rise for over two years. We were finally able to obtain approval for the project in this area on a very stringent budget. In the meantime the cost of labor and materials have increased tremendously. Now to add a substantial cost at the last minute could make the project fail because it would be financially unsound. We hope these points will be given full consideration in any changes. Our Minimum Property Standards do not require the installation of sprinkler systems. We understand also that such a system is not a State code requirement. Further, the construction budget for this project did not provide sufficient funds to cover a sprinkler system which means that mortgage money would not be available. This has also been true of all our 236 highrises in the past. Nevertheless, this does not mean that we do not recognize the advantages of a sprinkler system in such a building, but we have been asked to comment on whether the Minimum Property Standards of HUD or the State Building Code require the system.
