The applicant is seeking approval of a sixth speculative
industrial building with an area of 167,892 sal. ft. (compared
to 146, 868 sq. ft. for Spec. Bldg. No. 5) .
Parking for industrial and Iarehousing would require 210 spaces;
41.5 spaces are provided. Given the requirements for office uses
(? space per 200 sq. ft.)o approximately 49 of the building
could be used for office type uses.
The Plans appear to be in order. We have had discussions with
the applicant relative to the terming along 69th Avenue .and
ulith Putt icul.ar regard for the masonry wall indicated at the end
of the access drive. We will discuss this in more,detail.
Approval would be subject to the following conditions:
I. The exterior finish and color of the building shal.?
be harmonious so to blend in with the overall neighborhood.
2. Plan approval is exclusive of all signery and no sigrery
shall be installed on the 69th Avenue side until approved
by the City Council..
3. All exterior lighting shall be of such design so to be
directed away from the residential areas northerly of the
site.
4. There shall be no access point onto 69th Avenue North.
5. Building plans are subject, to the approval of the
Building Inspector with respect to applicable building codes.
6. orainage and utility plans, including bermi.ng specifications,
are subject to the approval of the City Engineer prior to
the issuance of a building permit.
7. A performance bond and a performance agreement (in an
amount to be determined by the City Manager) shall be
submitted to the City to guarantee site improvements as
designated on the approved plans.

The applicant is seeking approval of amended building plans which
comprehend lowering the roof of the north wing of Spec Bldg. No. 6,
from 22 ft. to ,j ft. The height of the saute wing world r*main the

The applicant's intent is to provide tenant areas of a smaller
vculume; i.e., there would be no provision for future upper level
(mezzanine) expansican as in the standard tenant area.
The foundation for booth wings has been set in place. The width
of the north wing, by approved design, consists of 3 bays, as
compared to 4 bays in the south wing.
our initial concern is the impact this alteration in height would
have upon the visual appearance of the building from,69th Avenue.
A definite "screening" pattern has been established along the
highMay with the erectice of Buildings 4 and 5.
We have instructed the applicant to provide sight data indicating
in detail the north elevation of the building as seen from the
street and neighboring area.
We will be prepared to comment further as to a recoumendation on
the regdelt.

PERFCRIKANCE AGREEMENT
This agreement is entered into by Sheehy Construction Company ,
First party, to the City of Brooklyn Center, a r,,,unicipal corporation,
under the laws of the State of Aiinnescta, Second Party, as follows:
The Council. of the City of Brooklyn Cente- has approved(pur-
suant to City Ordinances) the development plans of the First Party.
subject to the execution of this performance agreement. In consid-
eration of such approval, the First Party (and its heirs, successors
or assigns) does covenant and agree to perform the following obli-
gations on the property known as 6800 Shingle Creek Parkway
"The paving of parking and driving areas with 2" hot -mixed bituminous
mat installed over a suitable base; installation of poured -in -place
concrete curbing along the perimeter of all parking and driving areas,
utilizing MHD B-612 design; screening of all mechanical equipment
located on the roof; installation of grass sod, trees and shrubbery
or other vegetative materials in areas not otherwise improved, in-
cluding sodding in the area between the property line and the curbline
of the adjacent street; irrigation system as required by Ordinance
Section 35-413; drainage and utility provisions as approved by the
City Engineer% and all other site improvements as described on
the plans as approved by the City Council on November 5, 1973.
First Party understands that the a proval by the City Council is
further subject to the furnishing of a "per;rma:ace bond" or "cash
escrow" determined by the City Man;ager in the amount of $ 60,000.00
to guarantee the First Party's performance of the foregoing obliga-
tions. Further, the First Party agrees that the initial installation
of the site improvements shall be completed on or before ll/1/74 -A-
and that the monetary bond (or a part thereof) may be retained by the
City for an additional period up to ll/l/75 , to guarantee
the maintenance of the items initially completed under this agreement.
A cony of this undertaking shall be attached to the corporate
surety bond and reference to this undertaking shall be made in such
bond, so that no corporate surety shall assert as a defense any lack
of reference in the bond to these undertakings.
