AGREEMENT
THIS AGREEMENT, made this 1 day of , 1961 between.
the Village of Brooklyn Cente1r, Minnesota,,a Municipal Cor:ioration, party
of the first part, and Ryan 'Lake``Prop%�rties, Inc., a Corporation
organised under the laws of the Stare of'Minnssota, party of thw second,
part.
WITNESSETH, that whereas the party of the second part, as tie
owners and developers of that certain tract of land located in -the Village
of Brooklyn Center, County of ; Hennepih, 'State of Minnesota, ^ known, and .
platted as Ryan Lake T rraceq is :desirous of erecting a certain sign,
lights and planters along',and upon the boulevard portion of the right-
of-way adjacent to 47th Avenue North, Said.sign, lights'and planter to
be installed in accordance.with the."sketch and plans prdviously sub-
matted to the party of the first part.
Now THEREFORE, in consideration of the mutual agreements of the'
parties hereto it is hereby agreed by.and between the pn;rties, as follo;+ss.`
1. Party of the' second part, 'for itself, `its successors and
assigns does hereby agree to construct and maintain said
sign, lights and planters, and further, to hold the party
of the first part free and harmless by reason of any lia-
bility, real or feigned, arising out of or from the erec-
tion, use or maintenance of said sign, lights and planters.
2. Party of -the second part, for itself, its successors and
assigns does hereby grant to the party of the first part
the right and privilege of removing the lights and planters
to secure access to public utilities.

It is the opinion of the VillAge Engineer that precedent and
esthetic value of the proposed gas ? sghts, would €core than balance
any imaginable abjection to the cues 1.1ghts. It is also, boieieved,
the op aian of the Engineer that any variance granyed regard ng the
proposed lights should be c*nditional upon Ryaa Lake Propel -ties,
Inc. submitting a signed statement to the Village which would hale
said Vi}?age h-.rm3ass 116rom a€s4• action or responsibility involving
the lights, and further agreeing to remove said lights fr(ua Villege
property as suture conditions warrant.
