Request: Variance
The applicant has owned the property since 1947; it was approximately then that
the large Bellvue Acres lots were divided by metes and bounds description.. P;4os',
of the lots are now known as the N 1/2 or S 1/2 of the E 1/2 (or W 1/2) of the
particular lot.
For example, the applicant's home. until April, 1975, was on the N 1/2 of the
E 1/2 of :.ot 3, Bellvue Acres, About two years ago permission was granted (-y
variance) to build a new dwelling or, the loft south of the applicant's home,, and
that property is known as the S 1/2 of thF° E 1/2 of Lot 3.
.Last April the applicant combined his lot with the adjacent one to the north for
tax purposes. He now desires to separate the combined parcel to the original
dimensions, by mates and bounds description rather than by platting.
Technically, there is another variance Involved: the propoaed lot width is
approximately 65 feet (same as original and comparable to other lots in the Suh-
divislon) o This action would be consistent with the intent of the draft ordinance
amendment,, currently before the Commission, which would permit Single famiiy
t lots of 60 feet width in the R-2 District. 1t would also be corisistenr: with prior
v va.rtances in this area. The property has been assessed for two utility connection.z
The substance of the request is the means by which the division is to be allowed.
The proposed vacant parcel is not typical in legal description to other lots in the
area; due to a jog in the rear lot line,, the description is lengthy and complex:
Commencing at the northwest corner of Lot 2, Block 2, Bellvue
Acres, thence south along the west line thereof 63 feet, thence
east 132.59 feet to the point of beginning of the tract of land
heraby to be described; thence southeasterly to a point in the
south line of said Lot 2, distant 142.34 feet west from the
souitheast corner of said Lot 2 , thence ease: 142.34 feet tee the
southeast corner thereof, thence northwesterly along the east
line of said Lot 2 a distance of 65048 feet, thence vjvest to the
point of beginning a distance of 132.59 feet, more or less
This contrasts sharply with the other cescriptions, such as the balance of the
parcel: the N 1/2 of the E 1/2 of Lot 3
One of the reasuns for formal platUng is to eliminate thI s type of ci,)m.bersome
language describing residential lots.

This has been the general policy, and several plats involving comparable lots and
descriptions have been approved in this area
The applicant ccnterads platting waLild be prohibitive due to expep..se, and that
metes and bounds division would result In tv.-,o lots which in fact existed prior to
the combination in April, 1975
Thus,, there is a basic policy question: does the request represent a deviatiO3.d
from the policy of requiring platting in, all cases where the descriptions are let gt.i'y .,
complex or never platted.
The standards for granting a variance from the Subdivisic;r_ Ordinance are:
1. That there are special circumstances or conditions affecting
said property such that the strict application of the provisions
of this ordinance would deprive the applicant of the reasonable
use: of his land.
2. That the variance is necessary for the preservation and
enjoyment of a substantial property right of the petitioner.
3, That the granting of the variance will not be detrimental to
the public welfare or injurious to tither properfy in the
territory in -which said property is situated,
