Three (3) copies of the following documents and information shall be submitted, at least 14 days prior to the date of the regular Commission meeting, concurrent with filing the application (required documents must be consistent with ordi- nance and policy provisions before an application may be accepted): I. A certified site survey drawing by a registered engineer`or land surveyor showing pertinent existing condition, accurately.dimensioned. 2.* An accurately scaled and dimensioned site plan indicating: a) parking layouts including access provisions; b) designations and locations of .accessory buildings; c) fences, walls or other screening, including heights and type of material; d) outside lighting provisions, type and location; e) curbing. 3.* A landscape plan showing areas to be sodded or seeded; location, size and species of trees and shrubbery. 4.* Building floor plans, elevations, sections and specifications, including .materials proposed. 5.* Existing and proposed land elevations, drainage provisions, and utility provisions. 6. Additional drawings, plans or information deemed necessary by the Secretary. *Must be prepared by a registered architect or person registered with the State Board of Registration for Architects, Engineers and Land Surveyors, and said drawings/plans shall be so certified. NOTE: Upon approval of plans by the Council and prior to issuance of permits, a Performance Agreement as to approved site improvements and a supporting finan- cial guarantee, in an amount to be determined by the City, are required. Accept- able financial instruments include cash escrow; certificate of deposit; and performance bond. Copies of the Zoning Ordinance may be obtained from the Administrative Office. P/I Form No. 19 Planning Commission Information Sheet Application No. 83049 Applicant: Erland Shelley Location: 5200-70th Avenue North Request: Special Use Permit/Home Occupation The applicant requests special use permit approval to engage in taxidermy in the garage of the residence at 5200-70th Avenue North. Home occupations which involve the use of an accessory structure are by definition in the special use category. The property in question is zoned R1 and is bounded by single-family homes on the east and west, by The Ponds Townhouses on the north, and by 70th Avenue North on the south. The applicant has submitted a brief letter (attached) describing the proposed home occupation. Mr. Shelley explains that he has a federal and a state license to do taxidermy and wishes to use his attached garage as a work shop. He states that he has weekly refuse disposal service by Brooklyn Disposal Company. Carcasses are frozen until disposed of. He states that the home occupation involves no chemicals other than those normally found in a home or garage. Mr. Shelley points out that he has a three car driveway and that customers would bring work on an appointment basis. He notes that 60% of his work is for himself and that he does no retail sale of his work. He also states that there is no noise involved in the work. In addition, the applicant has two fire extinguishers in the garage. Typically, home occupations involving garages are limited to no more than one half the floor space of the garage so that a car can still be parked in it or it may be used for storage, accessory to the residential use. The garage, in this case, is a single -car, 14' x 22' garage which cannot normally contain more than one car. The applicant has indicated that he will do the work on tables along the side of his garage and will still park his car or van in the garage. No set hours of operation have been proposed and staff feel it is unnecessary to set them for what is essentially a hobby craft home occupation with no noise impact. In general, we see no conflict with the standards for a special use permit, nor with the ordinance provisions relating to home occupations. Approval is, therefore recommended, subject to at least the following conditions: 1. The special use permit is issued to the applicant as operator and is nontransferable. 2. The special use permit is subject to all applicable codes, ordinances, and regulations and any violation thereof shall be grounds for revocation. 3. The home occupation may not occupy more than 50% of the accessory structure. 4. A fire extinguisher of at least 5 lb. capacity shall be kept in the garage. 5.
