The land in question is zoned C2 and is the site of the proposed Target store and retail center (see Application No. 85001). The proposed legal description of the property is simply Lot 1 and Lot 2 of Block 1, Brooklyn Center Village Addition. Staff have requested an alternate name to avoid confusion with the City. Lot I is the location of the retail center. Lot 2 is the location of Target. The total area of the plat is 13,432 acres. No lot areas have been provided, but Lot 2 is by far the larger lot. Existing grades are provided on the preliminary plat survey. A 10' wide utility easement is provided along John Martin Drive and along Shingle Creek Parkway. We are seeking sidewalk easements along Shingle Creek Parkway and Summit Drive to accommodate sidewalks in areas where turn lanes are proposed. In general, the plat appears to be in order and approval is recom- mended subject to at least the following conditions: 1. The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances. 3. The plat shall be modified to include sidewalk easements in accordance with the recommendations of the Director of Public Works. 4. The name of the preliminary plat shall be revised so as to avoid any confusion with the City of Brooklyn Center prior to preliminary plat approval. 5. The applicant shall enter into a Subdivision Agreement with the City stipulating responsibility for and assessment of costs for certain improvements to public facilities within the public right-of-way, including, but not limited to: a. potential installation of traffic signals at John Martin Drive and Shingle Creek Parkway and at Summit Drive and Earle Brown Drive (west). b. installation of deceleration lanes serving accesses on Shingle Creek Parkway and on Summit Drive. C_ al TO: Joe Oster, Public Works Coordinator ' "" FROM: Jim Grube, City Engineer Ir DATE: March 20, 1985 RE: Subdivision Agreement On March 19th a meeting regarding the content of a Subdivision Agreement for the Target development was attended by Gerald Splinter, Sy Knapp, Jim Grube, Ron Warren and Gary Shallcross. The attendees considered the following subjects to be essential in the document development: 1. Improvements to be made by City with assessment to be levied against the subdivision A. Right in/right out and deceleration lane along Shingle Creek Parkway B. Sidewalk modification along Shingle Creek Parkway to accommodate items A above C. Deceleration lane along Summit Drive at main access to site Note: City will construct improvements in 1986. 20% cash downpayment is necessary. 2. Unpaid current assessments I will formulate necessary exhibits regarding split of assessment 3. Advance payment of special assessment This is a "boiler plate" item 4. Future utilities connections and hookup charges No future charges will be made, but a statement to that effect is advised 5. Other responsibilities of the owner A. Owner shall construct necessary structures to restrict traffic movement in such a way as to insure that traffic congestion on the City streets will be minimized. I. Owner will pay SAC charges. Please be advised that the draft copy of the Target development Subdivision Agreement must be submitted to Sy by March 26th for comment. The corrected draft must be prepared for mailing to the developer by April 2nd. The City Manager has established the following timetable: April 22, 1985 - Informal review of preliminary and final plats, Subdivision Agreement, and site and building plans by City Council. May 20, 1985 - Formal review and approval of documents submitted on April 22, 1985. Building plans are subject to review and approval by the Building Official with respect to applicable codes prior to the issuance of permits. 2. Grading, drainage, utility and berming plans are subject to review and approval by the City Engineer, prior to the issuance of permits. 3. A site performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted prior to the issuance of permits to assure completion of approved site improvements. 4. Any outside trash disposal facilities and rooftop mechanical equipment shall be appropriately screened from view. 5. The building is to be equipped with an automatic fire extinguishing system to meet NFPA standards and shall be connected to a central monitoring device in accordance with Chapter 5 of the City Ordinances. 6. An underground irrigation system shall be installed in all landscaped areas to facilitate site maintenance. 7. Plan approval is exclusive of all signery which is subject to Chapter 34 of the City Ordinances. 8. The replat of the property shall receive final approval by the City Council and be filed at the County prior to the issuance of building permits. 10. The applicant shall amend the name of the development and the plat so as not to be confused in any way with the City of Brooklyn Center prior to preliminary plat approval. 11. Plan approval excludes the restaurant portion of the project which is subject to future review and approval. 12. All outside storage in the garden center area shall be effectively screened from view by an opaque masonry wall. Excepted from this condition are the tops of tree seedlings. The .Secretary then explained that because a moratorium on retail development would go into effect on February 23, 1985, the applications would not be considered by the City Council until the May 20, 1985 meeting when the moratorium would expire. APPLICATION NO. 85004 (Cathy Rausch) The Secretary then introdu ed the next item of business, a request for special use permit approval to conduct a home be uty shop with one non- resident employee in the exi ting family of the residence at 3000 63rd Avenue North. The Secretary reviewed the con entsofthe staff report (see Planning Commission Info mation Sheet f r Application No. 85004 attached). The Secretary note that a prev ous home beauty shop with a part-time nonresident employe was approv d in the past, but this was before on -street parking was lowed f r home occupations. The Secretary also discussed other si ation in which on -street parking has been allowed, primarily for g oup essons. Commissioner Sandstrom noted that it d a possible for three cars to be parked on 63rd Avenue North and note d\\ at the conditions of approval would limit parking to two cars on 63r Avenue North. The Secretary stated that on -street parking shoo d be minimized, but that two additional spaces would probably be ee ed in addition to the three stalls that were possible on the ot. The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances. 3. The plat shall be modified to include sidewalk easements in accordance with the recommendations of the Director of Public Works. 4. The name of the preliminary plat shall be revised so as to avoid any confusion with the City of Brooklyn Center prior to preliminary plat approval. 5. I have been approached by Hansen,Thorpe, . regarding the feasibility of joint preliminary/final plat approvals on May 20th, therefore, I recommend that staff compile a "laundry list" of all the items/conditions which must be met in order for the development to be granted outright approvals.
