Request: Variance and Site and Building Plan Approval
This application contains two parts, the first of which comprehends a variance
to permit the proposed structure to have a virtual "zero lot line" setback on the
north side rather than the required 10 ft. minimum building setback. The north
property line is the municipal boundary with the City of Brooklyn Park, and the
applicant also owns an approximate 12 ft. wide strip of land in the City of
Brooklyn Park adjacent to the municipal boundary. The request is essentially a
recognition of the uniqueness of the situation where the property is split by
a municipal boundary thereby requiring the 12 ft. in Brookly Park to be a separate
parcel.
A public hearing has been scheduled on the variance.
It is our recommendation that the situation is unique, and that the hardship can
be attributed to the legal split of the property by a municipal boundary. If
the applicant were required to provide the minimum setback from the municipal
boundary, it would require locating the parking lot closer to the Shingle Creek
easement and actually using part of the easement for parking. The Commission
had indicated during the rezoning of this property last year that, if at all
possible, use of the Creek easement should be avoided.
A condition of the variance which is recommended and which the applicant has
agreed to, is that a legal encumbrance shall be placed upon the 12 ft. wide parcel
in Brooklyn Park, declaring that the use of that parcel is to be open space and
greenstrip. We have received a communication from the City of Brooklyn Park re-
garding this matter, and a copy of that letter is enclosed.
As a matter of perspective it should be noted that the variance action would not
be recommended if the applicant did not own the property on the other side of the
municipal boundary, and the applicant was not prepared to encumber that property
as open space.
The second part of the application involves site and building plan approval for an
approximate 10,000 sq. ft. two -level office building. This property was rezoned
last year to C-1 (Service/Office Commercial) and the proposed use is within the
ordinance requirements.
The plans provide for a public easement along Shingle Creek, and as we discussed
at the last meeting under Application No. 78015 which is also on this agenda, a
clarification of that easement as well as the southeasterly property line
description hopefully will be accomplished through the replatting of this property.
We will be prepared to discuss this matter in further detail.
The applicant will be removing or demolishing the single family home and accessory
buildings, and will be providing the property with municipal sewer and water.
We will be prepared to discuss the site and building plans in detail at the meeting.
Approval would be subject to at least the following conditions:
Application No. 78020 continued:
1. Building plans are subject to review by the Building Official
with respect to applicable codes prior to the issuance of
permits.
2. Grading, drainage, berming and utility plans are subject to
approval by the City Engineer prior to the issuance of permits.
3. A Performance Agreement and supporting financial guarantee (in an
amount to be determined by the City Manager) shall be submitted to
assure completion of the approved site improvements.
4. An appropriate legal encumbrance approved by the City as to form
and content shall be filed against the adjacent property in Brooklyn
Park,which is owned by the applicant, establishing the use of said
parcel as required open space to be maintained with landscaping
as the side yard of the proposed office building. Evidence that this
covenant has been appropriately filed with Hennepin County shall be
submitted with the application for permits.
5. All outside trash disposal and any rooftop mechanical equipment
shall be appropriately screened from view.
6. The building shall be equipped with an automatic fire extinguishing
system to meet or exceed N.E.P.A. Standard No. 13.
