Variance from. Sec. 35-402 to permit a greater number of dwelling units on the property than is permitted by zoning regulations. The property Lies north of County Road #10 between Xer.zes Avenue and Shingle Creek. (Tract D, R.L, S. No. 1.166) Center Development Co. 3) An application very similar to this one was submitte6 in May of 1966, also requesting approval of plans and a variance on density. The requests were denied by the Council on ?august 15, 1966. Since that time, the site plans have been -revised, but the site plan still contains 276 apartment units on 15.22 acres of land, approximately 30 .snits over the 245.55 unit maximum permissable using the figure of 2700 square feet of land per dwelling unit in an R5 inultiple. dwelling zone. POINTS TO BE CONSIDERED: 1) The Commission will recall that in its proposed zoning ordinance and in the denial of the previous va.rianCe request on this property, the only a:tterat on in the density requirement of 2700 square feet of land: per 11wel? ing unit t:7as based on the installation of par*k:ing space v.nderground or under buildings. 2) The site plan submitted is in accord writh the standards of the zoning ordinance in all respects but c"leaisity and the d.:,irltensions of parking areas. It is c�zi%e possA-13le in t,ie future., as Brooklyn Center becomes more cosraopolitan in .2 -- in its attitudes, that greater densities for dwelling units will be permitted. This change is an evolutionary process, however, and I do not feel that the City at - present is prepared to lower these density requirements. Rather, I suggest the deletion of the three 12 unit buildings shown on the site plan to bring the total nu ber of units under the 245 units permitted by the present ordinance, then, in the future, if the density standards do become more liberal, the developer will have those spaces remaining into which he may insert those deleted buildings. The deletion of one twelve unit building would leave the development "balmiced" in design, but st:.il.l at an excessive density; the deletion of two twelve unit buildings would throw the design out of "balance", and still leave an excess of approximately 6 units in the developments the deletion of all three 12 unit buildings would peat the design back in "balance" but would put the number of units on the property at approximately 6 less than are permitted by ordinance. I feel quite certain than the developer will use this argument and the example of Turin Realty to the northwest of Highways ##100 and #152 where a variance of 2.5 units `• was granted to allow him, a variance in :his ease. 2) The standard performance agreement and bond are recommended. pLANNING COMMISSION INFORIIIATTON SHEET Application No. 67012 Applicanto Norman Chazin Description of Request! Property Location.- Four Courts Apartments Xerxes Avenue and Horthway Drive BACKGROUND 1) When Application No, 67012 was originally approved, the plans for the swimrni.ng pool, recreation building and central open space area were not complete and therefore could not be included in such approval., 2) Due to soil conditions, the developer is proposing to eliminate the lagoon and create a contoured green area, 3) There will be no changes in the vehicular parking and driving areas.
