Request: Preliminary Plat
The applicant requests preliminary plat approval to subdivide into two lots,the land
at 7223 Brooklyn Boulevard which is presently described as Lot 1, Block 1, Piccadilly
Pond Addition. The new addition is to be known as Red Lobster Addition, Lot 1 of
which will abut Brooklyn Boulevard on the east. Lot 2 will be landlocked, but will
have access via the private road within Lot 2 of Piccadilly Pond Addition. Lot 2
of the proposed subdivision will be used for an off -site accessory parking lot
(See Application No. 82012) for the proposed Red Lobster restaurant.
The land areas of the parcels are:
Lot 1: 61,402 s.f. 1.4096 acres
Lot 2: 76,238 s.f. 1.7502 acres
These land areas will meet the proposed standard of 1 acre minimum lots for com-
mercial developments along major thoroughfares. The Shingle Creek right-of-way is
contained within the subdivision. Much of the land within the proposed subdivision
lies within the Flood Plain district (flood fringe north of Shingle Creek right-of-
way). The parking lot proposed for Lot 2 is a permitted use within either floodway
or flood fringe districts.
A 15' wide drainage and utility easement is retained along the north side of the
lots, adjacent to the private roadway. Access to the private roadway on the C.E.A.'P.
property is guaranteed by previous plat documents.
Approval of the plat is recommended subject to at least the following conditions:
1. The final plat is subject to review and approval by the City
Engineer.
2. The final plat is subject to the provisions of Chapter 15 of the
City Ordinances.
3. Lot 2 shall be encumbered to the sole use of the Red Lobster
Restaurant on Lot 3, Block 1, Piccadilly Pond Addition for
parking purposes, such encumberance to be a perpetual
covenant running with the land until released by the City.

THIS INDENTURE, made and entered into this day
of April, 1982, by and between
ROBERT L. JOHNSON and MARCENE S. JOHNSON,
his wife (hereinafter referred to as
"Grantors")
and
CAMDEN NORTHWESTERN STATE BANK OF MINNE-
APOLIS, a Minnesota corporation (herein-
after referred to as "Mortgagee")
and
CITY OF BROOKLYN CENTER, a municipal
corporation (hereinafter referred to as
"Brooklyn Center")
W I T N E S S E T H:
WHEREAS, Grantors own fee title to certain real property
located in the City of Brooklyn Center, County of Hennepin,
State of Minnesota, and described as follows, to -wit:
Lots 1, 2 and 3, Block 1, Piccadilly Pond,
Hennepin County, Minnesota, according to
the plat thereof on file or of record in
the office of the County Recorder, Hennepin
County.
WHEREAS, Mortgagee holds a first mortgage on the above -
described property;
WHEREAS, Grantors also hold fee title to certain
real property located in the City of Brooklyn Park, County
of Hennepin, State of Minnesota, and described on the attached
Exhibit A (hereinafter referred to as "Brooklyn Park Property");
WHEREAS, the Grantors have caused a portion of Block 1,
Piccadilly Pond to be replatted as Lots 1 and 2, Block 1,
Red Lobster Addition, and Brooklyn Center has approved said
replatting on the condition that Grantors place certain
conditions and restrictions on the property to be developed;
WHEREAS, the Grantors, the Mortgagee, and Brooklyn
Center are desirous of imposing the required restrictions
on the above -referenced properties;
NOW, THEREFORE, in consideration of the foregoing,
the undersigned hereby covenant as follows:
1. Grantors and Mortgagee hereby declare, as a
covenant running with the land and binding their grantee,
its successors and assigns, that Lot 2, Block 1, Red Lobster
Addition shall be used solely for parking purposes for the
sole benefit of the restaurant located on Lot 3, Block 1,
Piccadilly Pond. Said covenant shall run until released
by Brooklyn Center.
2. Grantors and Mortgagee hereby declare, as a
covenant running with the land and binding their grantee,
its successors and assigns, until said covenant is released
by Brooklyn Center, that no structure shall be constructed
within fifteen (15) feet of the northern lot line of Lots 1
and 2, Block 1, Red Lobster Addition and that no parking
improvement or facility shall be constructed within ten 1
(10) feet of the northern lot line of Lots 1 and 2, Block 1,
Red Lobster Addition.
3. Grantors and Mortgagee hereby declare, as a
covenant running with the land and binding their grantee,
its successors and assigns, until said covenant is released
by Brooklyn Center, that no structure shall be constructed
within fifteen (15) feet of the southerly lot line of Lot 3,
Block 1, Piccadilly Pond and that no parking improvement or
facility shall be constructed within ten (10) feet of the
southerly lot line of Lot 3, Block 1, Piccadilly Pond.
4. Grantors hereby declare, as a covenant running
with the land and binding their grantee, its successors
and assigns, until said covenant is released by Brooklyn
Center, that the Brooklyn Park Property shall be used
solely for the purpose of providing ingress and egress from
Brooklyn Boulevard to the restaurant located on Lot 3, Block 1,
