Setback variance
The applicant is seeking a rear yard setback variance
to permit construction of a proposed car washer bay
approximately 14.5 feet fron, the lot line. The rear
yard setback requirement in C-2 districts is 40 feet.
ANALYSIS Axle RECOMENDATION
Though not indicated on the initial plans, there is an
enclosed extension of the station which is situated
approximately where the car wash bay would be built. The
required setback is thus currently encroached -apon.,
There is an apartment building on the R-5 parcel to the east
There are precedents for rear setback variances; it is
the applicant's contention that a hardship is realized
in that an attached car wash bay would not be physically
possible elsewhere on the site.
Given the appropriate fencing and screening and lighting
requirements ?re: Application 72046); reconm►endation is
for approval.
