Boeck, Village Engineer Village of Brooklyn Center 7100 Osseo Road Brooklyn Center 22, Minnesota Dear Grady: MIDLAND SA1�`}c UILDING MINNEAPi, I,•MINNESOTA P FEDERAL 2-8076 This letter is in response to yours of April 13, 1960 concerning the requested rezoning of part of Lot 4, Block 5, Wangstad's Brooklyn Terrace Addition. It is my understanding that this matter is presently pending before the Planning Commission and is to be taken up at a special meeting scheduled for April 20. My under- standing of the facts is that the petitioner proposes to construct a multiple dwelling on a tract of land approximately 118 feet by 216 feet. Apparently in order to construct the kind of building that is contemplated, the petitioner is required to use an additional 20 feet of frontage along Osseo Road. The former tract of land, excluding the additional 20 ft. strip, previously had certain deed restrictions which would preclude the construction of this kind of a building, but these restrictions have been removed by agree- ment of the parties. It appears, however, that the additional 20 feet has such restrictions on the property at the present time. You have requested our opinion as to whether or not this should preclude the rezoning of the property. It is my opinion that the existence of deed restrictions has no effect on the power of the municipality to rezone property. In other words, the Village of Brooklyn Center can change the zoning of this property or let it remain as presently zoned without re- gard to the existence of such deed restrictions. The deed restric- tions are a matter of private covenant or agreement between the owners of adjoining property, and if there is any violation of such covenants or agreements the remedy is for action against the private person who violates such agreement. The Village is in no way in- volved in such private restrictions. I have talked to a Mr. Oslund, the attorney representing the peti- Mr. Graydon R. Boeck April 18, 196o Page 2 tioner in this case. He has been advised of the particular pro- blem and will undertake to clarify the situation as to the addi- tional 20 feet in order to protect the petitioner's interest therein.
