Site and Building Plan approval The applicant seeks approval of plans for an approximate 1,300 sq. ft. Fish and Chips restaurant on tiie site of the former Mobil oil, service station. In August, 1970, the Council considered Application No. 70040 submitted by the present applicant; the matter was tabled by fine Council at the applicant's request, following --a discussion of reign ordinance requirements restricting roof signs. This application involveF a different site and the plans indicate no proposed roof signery; rather, there is a mansard -like roof around the perimeter of the building (vs. a mansard -looking plastic roof sign on the front) . Plans indicate the building will be equipped with an automatic fire sprinkling system. Points for consideration include: 1. Seating and Parking. Plans call for 56 inside seats plus 5 employees at the average maximum Shift; thus a minimum of thirty spaces is required. 32 spaces are provided. The applicant proposes 3 outside patio tables, which obviously would be seasonal. The plans do not include a design or details of this seating; it is recommended such information be provided before the outside seating is installed. 2. Site layout and landscaping. The ordinance requires a six root opaque fence or approved screening between the parking lot and any abutting residential property. NU E7 a s�� M PLANNING COMUSSION INFrJMAT ION SHED Application ?No. 74056 Applicant: Arthur Treacher's Restaurants Location: 6100 Brooklyn Boulevard Request% Site and Building Plan Approval The applicant seeks approval of plans for an approximate 1,800 square root Fish and Chips restaurant on the site of the former Mobil Oil service station. In August 1970, the Council considered Application cdo. 70040 suWitted by the present applicant; the matter was tailed by the Council at the applicant's request, .following a discussion of sign ordinance requirements prohibiting roof signs. The plans call for 56 seats inside, with S employees at the average maximum shift; thus a minimum. of 30 spaces could be required. The submitted plans indicate 36 spaces provided; however, 4 of these are not feasible in terms of accessibility. Thus, 32 spaces are available, resulting in an excess of 2. The applicant has indicated a desire to have some outside seating at the front of the restaurant; based upon spaces available, there could be 4 such seats. 2. Site layout and landsca ing. The four spaces mentioned above are on the north o he lot; the area should be filled in with berming and/or plantings. The ordinance requires a six foot opaque fence (or approved screening) on the perimeter- abutting residential property. In this case, such a fence is shoran along the east line. -- to connect with Burger King' s screen wall - and partially on the south line. There is a question whether such a wall is necessary the entire length of the south line which abuts the vacant land used for density purposes by the Planning Commission Information Sheet (Cont'd) No. 74056 apartment complex to the east. Shrubbery and trees clay be more aesthetic. The Director of Public Works will be prepared to discuss several aspects of the site development .including drainage and reinstallation of the city sidewalk, which may be disturbed when the existing two curb cuts are removed. Consideration should be given to additional tree plantings, particularly at the east side and the corners. Approval Mould be subject to the following conditions. 1. Building plans are subject to review by the Building Official with respect to applicable codes, prior to issuance of a permit. 2. Grading, drainage, utility and berm?ng plans are subject to review by the City Engineer prior to the issuance of permits. 3. A performance agreement and financial agreement ( in an amount to be determined. �. by the City Manager) shall be submitted to guarantee comvlet.i.on of approve -Al site improvements. 4. All trash disposal and mechanical equipment shall be appropriately screened. 5. The property shall be replatted according to the requirements of Chapter 15 of the City Ordinances, within one year from the date of approval V 4� �► ^�.. %10 �Roo KLVN L PLANNING AND INSPECTION DEPARTMENT File No. 74056 PERFORMANCE AGREEMENT This agreement is entered into by ARTHUR TREACHER'S FISH & CHIPS party, to the City of Brooklyn Center, a municipal corporation, laws of the State of Minnesota, Second Party, as follows: , First under the The Council of the City of Brooklyn Center has approved (pursuant to City Ordinances) the development plans of the First Party subject to the execu- tion of this performance agreement. In consideration of such approval, the First Party (and its heirs, successors or assigns) does covenant and agree to pe`1f'orm the following obligations on the property known as 6100 Brooklyn Boulevard The paving of parking and driving areas with 2" hot -mixed bituminous mat in- stalled over a suitable base; installation of poured -in -place concrete curbing along the perimeter of all parking and driving areas, utilizing the MHD B-612 design; screening of all mechanical equipment located on the roof; installation of grass sod, trees and shrubbery or other approved vegetative materials in areas not otherwise improved, including sodding in the area between the property line and the curbline of the adjacent street; irrigation system as required by Ordinance Section 35-413; drainage and utility provisions as approved by the City Engineer; platting of property; appropriate screening of outside trash disposal facilities; and all other site improvements as described in the City Council approval of January 20, 1975. tarty u,rd-rstands that the approval by the City Council is further subject to the furnishing of a "performance bond" or "cash escrow" deter- mined by the City Manager in the amount of $25,000.00 to guarantee the First Party's performance of the foregoing obligations. Further, the First Party agrees that the initial installation of the site improvements shall be completed on or before 3/1/76 , and that the monetary bond (or a part thereof) may be retained by the City for an additional period up to 3/1/77 , t.c guarantee the maintenance of the items initially com- pleted under this agreement. A copy of this undertaking shall be attached to the corporate surety bond and reference to this undertaking shall be made in such bond, so that no corporate s,,jrety shall assert as a defense any lack of reference in the bond to these undertakings.
