Request: Variance from Section 35-330 to allow erection of a 28'4" freestanding sign containing approximately 281 square feet of gross surface area, Property: Lot 2, Block 1 P. B. C. First Addition Owner of Property: W. 0, Patterson BACKGROtM : 1) Plans for the 3urger-King Restaurant were approved by the Tillage Council October 11, 1965, but the freestanding sign was srlecifically excepted from that approval POINTS TO BE CONSIDERED : 1) The proposed sign is 28'4" high and contains approximately 261 square Peet, 2) The proposed sign ordinance would allow a free-standing sign 6° high and 45 square feet in area. (plus other signs; see Section 3-1104 A>1,) 3) The applicant has not specified Whether the sign will be flashing, a) Signing for the property under iLhe present ordinance would be limited to approximately 280 square feet (140 foot; frontage on Osseo Road), and "Burger -King - (;ore o -he j'Jh0pi)6a" uu fife buildin(i wiil use unprox:imai;ely 62 square feet of it, STAFF CGI A?ENTS : D The CoMmission and Council should consider their proposed sigh ovdinance in granting the sign for this property as has been done in other recent applications., 2) S?nce the Burger Ying people have argued that they are not a "drive-in" so as to escape the requirement of a special use permit, we should apply the section of our proposed sign ordinance which pertains to cOmmercial uses excepting drive-ins (Section 31104 A.1> a,., bo, c;,, d,, and e,). It is understood that revisions Of the sign ordinance will be necessary, but the revisions wial p3 obably remain more liberal toward a drive-in. 3) If, in the ead, it is decided to allow Burger King the same signing as a drive-in,, one should renember that Bridgeman's has been granted a sign 27.1 feet above carb level (non rotating, corner lot, more than 50 feet from right-of-way, 250 feet in area) and Mr. Suds has been granted a sign 24 feet above curb level (rotating, corner lot, 15 Meet from right-of-way, total area of one side 180 feet or less and rotating portion 150 feet or less, and other conditions). The above signs have begun to remake our sign ordinance in regard to drive-ins 4) Heights of free-standing signs should be fixed in relation to centerline grade of the street perpendicular to the sign's location.
