1) This application is a repetition of one (#67001) sub-
mitted earlier this year by Bermel-Smaby. The former
application came before the Commission on Februin-, 2, 1967
and following the holding of a. public hearing on the
matter, the applicant requested that he be allowed to
withdraw his application to see if the property owners to
the north of his property would care to enter into a joint
development of their properties along with his, more in
line with the concept of a "planned development area" as
suggested in the Comprehensive Plan.
2) The two properties involved abut "old" 65th Avenue North
as that street was platted in Brooklane Addition. Since
the time of this platting, 65th Avenue has been relocated
south of its original position, across the northwest
corner of the Garden City School playground. This relocation
of the street has left the "old" 30 foot segraent of 65th
Avenue and a small piece of the school's property to the
north of the present 65th Avenue North.
POINTS TO BE CONSIDERED:
1) The Comprehensive Plan suggest that the parcels on the
northeast corner of the intersection of 65th and Osseo
Road should be redeveloped as a "planned development area",
No rezoning of the properties involved has yet been
suggested by the Commission or Council, however. The appli-
cant has stated an interest in these two properties, as
well as a portion of old 65th Avenue and a remnant of
property owned by the Osseo School District north of. new
65th Avenue as a site for its northern real estate office.

�- 2) The present use of the property across Osseo Road from this
property is for multiple dwellings; the property to the south
across 65th Avenue is the playground for Carden City
Elementary School.
3) Although there are covenants on most oil Hrooklane Addition
restricting the properties therein to single family dwelling
use, the applicant has stated that the properties involved
in this application are not covered by such restrictions,
and it is the Sta.ff's understanding that the properties at
6507 Ewing Avenue and 6510 and 6520 Osseo Road are also
free of restrictions.

It is my intention to proceed with the final rezoning of Tracts B & C, Brooklane
Addition, as requested by Bermel-Smaby some weeks ago. The necessary final
ordinance amendment will be acted upon at the City Council meeting of August
21, 1967.
As I have previously informed you, it will be necessary that the section of old
65th Avenue (which has since been relocated as part of the Osseo Road highway
construction) as well as the school property which your firm purchased just north
of the new 65th Avenue, be similarly rezoned for your proposed office use. In
addition, I have advised you that it will require a formal written request directed
from your firm to the City of Brooklyn Center to effect the vacating of old 65th
Avenue to the Bermel-Smaby Company with the City of Brooklyn Center retaining
an easement for utilities which it has within the old 65th Avenue right-of-way.
It would be my suggestion that the Bermel-Smaby Company arrange to have all
four parcels (Tract B, Tract C, old 65th Avenue, and the parcel purchased from
the school district) combined into a single parcel by a registered land surveyor
through the use of either a plat or a registered land survey. At the same time, the
surveyor could provide the necessary legal description of old 65th Avenue which
could then be used in your formal request for the vacation of old 65th Avenue. it
will be necessary that this be accomplished either prior to or concurrently with
your formal application before the City Planning Commission and City Council for
plan approval of the new facility which Bermel-Smaby proposes to construct.
