AGREEMENT
WHEREAS, prior to December 15, 1969 the Burger King Restaurant was
identified by a 286 square foot sign on its premises at 6110 Osseo Road,
Brooklyn Center, and
WHEREAS, such sign was rendered a non -conforming sign according
to the provisions of Section 34-120 of the Brooklyn Center Ordinance as
adopted on December 15, 1969, and
WHEREAS, the Burger King Company is alleged to be pursuing a company
policy of replacing such signs with a new sign design of 162 square foot size,
and
WHEREAS, without benefit of an authorizing permit from the City, such
non -conforming sign was removed from the premises at 6110 Osseo Road on
or about December 15, 1969 by Brede, Incorporated acting as a sign replacing
agent for the Burger King Company, and
WHEREAS, Brede, Incorporated contends that the removal of said non-
conforming sign without permit authorization was an unintentional act which
resulted in depriving client Burger King Company of a business identification
sign, and
WHEREAS, Section 34-130 of the Brooklyn Center Ordinance limits the
Burger King Restaurant located at 6110 Osseo Road to a single freestanding
sign not to exceed 104 square feet in area and 24 feet in height, and
WHEREAS, Brede, Incorporated contends that approximately 90 days will
be required to construct and install a new sign design not exceeding 104 square
feet in area, and
WHEREAS, the Brooklyn Center City Manager concedes that it would be
unreasonable to deprive the Burger King Restaurant at 6110 Osseo Road of an
identification sign during said approximate 90 day period,
It is therefore agreed as follows:
1. The non -conforming 162 square foot sign design may be installed
and maintained at 6110 Osseo Road while a conforming 104 square foot
sign is being constructed.
2. Brede, Incorporated agrees to remove said non -conforming
162 square foot sign prior to May 9, 1970.
