Planning Commission Information Sheet Application No. 82037 Applicant: Northport Properties Location: 5415 Brooklyn Boulevard Request: Rezoning The applicant requests that the land at 5415 Brooklyn Boulevard be rezoned from R1 to Cl. The parcel in question is the location of the Northport Medical Clinic and is bounded by Northport Elementary School on the west, a single-family home on R2 zoned land to the south, Brooklyn Boulevard to the east and a private access road to the school on the north. The parcel is approximately two-thirds of an acre in area, less than required by Section 35-400 of the Zoning Ordinance. However, the proposed zoning is consistent with the existing use and with the recommendation of the Comprehensive Plan. The applicant has submitted a written request (attached) in which he explains that the primary reason for the rezoning is to ensure that, if the building were destroyed, it could be rebuilt at its present location. No expansion or change of use is proposed at this time. The applicant argues that the existing clinic meets a neighborhood need and that the surrounding land uses have changed since its original construction. Therefore, he implies, the land should be rezoned to Cl to continue an existing, necessary function at this location. The clinic was built on this site in 1960. It appears to be substandard as to its front yard setback (about 43' rather than 50' as presently required). .The site .has 26 parking stalls (22 are required). There is a 25' wide greenstrip on the south side of the property (15' is required). There is vegetative screening along the westerly portion of this property line. The rest is open. The parking lot is not striped or curbed. These structural deficiencies are typically dealt with at the time the owner wishes to expand or seriously alter an existing structure. As was the case with Howe Fertilizer, destruction of an existing structure would not guarantee the right to rebuild at a substandard setback. Rezonings are to be evaluated in light of the guidelines established in Section 35- 208 of the Zoning Ordinance (attached). Generally, staff feel these guidelines are met in this case. Of special importance is the fact that the proposal is consistent with the City's Comprehensive Plan. As with all rezonings, it is recommended that the Planning Commission table the matter and refer it to the Southwest Neighborhood Advisory Group for review and comment. A public hearing has been scheduled and notices have been sent. 10-14-82 Planning Commission Information Sheet Application No. 82037 Applicant: Northport Properties Location: 5415 Brooklyn Boulevard Request: Rezoning The applicant requests rezoning from R1 to Cl of the land on which the Northport Medical Clinic is presently located, 5415 Brooklyn Boulevard. This application was considered by the Planning Commission at its October 14, 1982 meeting. At that time, the application was tabled and referred to the Southwest Neighborhood Advisory Group for review and comment. The advisory group met on November 10, 1982 at Northport School to consider the rezoning (see minutes attached). Those present recommended favorably on the request and the matter is again before the Commission for recommend - to the City Council. In addition to the minutes of the Neighborhood Advisory Group meeting, the following materials are also attached for the Commission's review: 1. A copy of the October 14, 1982 Planning Commission minutes relating to Application No. 82037. 2. The Planning Commission Information Sheet for Application No. 82037. 3. A letter from the applicant requesting the rezoning. 4. A map of the area showing the location of the property in question and the existing zoning districts in the area. 5. A site plan of the property showing the location and dimensions of the clinic and parking lot. 6. A copy of Section 35-208 of the City Ordinances regarding the Rezoning Evaluation Policy and Review Guidelines. 7. Table 14,"Land Use Plan Revisions" and Figure 15, "Land Use Plan Revisions Map" from the updated Comprehensive Plan which designates this area for Service/Office use (Cl). In light of the recommendation of the Comprehensive Plan, staff feel the rezoning should be approved as requested. We do not recommend any expansion of the area to be rezoned at this time. The Comprehensive Plan recommends that the land to the south of the clinic remain low -density residential. The land north of the clinic is recommended for Service/Office use; but the policy of the City, with respect to Comprehensive Plan recommendations, is not to upzone property until a specific development plan which meets ordinance requirements is submitted for approval concurrently with a rezoning proposal. We therefore, recommend approval of the rezoning as requested. We will have a draft resolution recommending approval available for the Planning Commission at Thursday night's meeting.
