Request: Review of Revised Master Plan and Landscape Plan
The City Council, on October 4, 1976, approved Application No. 76054 submitted
by Brookdale Ford. One of the conditions of approval was that a revised master
plan and detailed landscape plan would be submitted for further review. This_ matter
was brought to the attention of the Planning Commission on June 9,,1977, and it
was explained to the Planning Commission that the revised master plan and detailed
landscape had not yet been completed. Also, at that time, Brookdale Ford was
negotiating with Northern States Power Company to acquire, or to lease, NSP
property to the north of the site. Brookdale Ford has since acquired the NSP
property and has submitted preliminary master and landscape plans which have been
reviewed by the City Engineer. Certain modifications to these plans have been
recommended and at the time of the preparation of this agenda the revised plans
have not been reviewed. It is anticipated that the plans will be reviewed prior
to the Planning Commission's Thursday evening meeting. It should also be pointed
out that Brookdale Ford is negotiating the purchase of a triangular piece of
property to the northwest of the site and will propose some modifications such
as the closing off of the present entrance on Shingle Creek Parkway and the
addition of a new entrance to the north if they are successful in acquiring the
property. In lieu of this, some temporary improvements such as bituminous
curbing, rather than concrete curbing, in the area of the present entrance are
recommended.
Attached is a copy of a June 1, 1978 letter from former Director of Planning and
Inspection Blair Tremere to Mr. Glen Lieder of Brookdale Ford regarding various
requests made of the applicant. The Commission, in its review, should pay
particular attention to the landscape plan and its consolidation with site planning.
Other recommendations from the staff may be forthcoming following review of the
plans prior to the Commission meeting.
Approval of the application would be subject to at least the following conditions:
1. Site, grading, drainage, utility and berming plans are subject to
approval by the City Engineer prior to the issuance of permits.
2. A Performance Agreement and supporting financial guarantee (in an
amount to be determined by the City Manager) shall be submitted to
assure completion of approved site improvements.
3. All landscaped areas, including perimeter greenstrips shall be
equipped with underground sprinkling systems as approved by the
City Engineer.

Request: Update on Status of Site Improvements
The applicant submitted Site and Building Plans for approval last year and received
Council approval on October 4, 1976. One of the conditions was that a detailed
landscape plan and master plan for the Ford dealership would be submitted to the
Planning Commission during the month of June 1977. We have met with the applicant
and have discussed the status of those site improvements and the layout.of a master
plan for the site.
You may recall that consideration was being given to use of property owned by NSP
which has now removed the power line structures that ran across the parcel. The
applicant has begun negotiations with NSP for the acquisition of the land.
The applicant has not completed the master plan or master landscape plan for the
property pending those negotiations as well as a determination of the probable use
of the large vacant commercial property to the north since there may be common
interests involved with respect to access onto Shingle Creek Parkway.
We will be prepared to discuss the plans and the status of the applicant's nego-
iations in further detail.

THIS INSTRUMENT made this qd'` day of r�_aey,1065, by and between

Northern States Power Company, a Minnesota corporation, hereinafter call ed
"NSP", and Village of Brooklyn Center, a public corporation in Hennepin
County, State of Minnesota, hereinafter called "Village";
WITNESSETH:
WHEREAS, NSP is the owner of a certain tract of .land situated in Hennepin
County, State of Minnesota, a portion of which is needed by Village for
temporary roadway purposes as a result of certain highway construction;
NOW, THEREFORE, in consideration of the mutual promises and covenants
hereinafter contained, NSP hereby grants to Village a temporary permit to use
the following described tracts of .land for temporary roadway purposes, to -wit:
Commencing at the Northeast corner of Lot Eight (8), Auditor's
Subdivision #218, Hennepin County, Minnesota; thence North-
easterly to'a point on the West .line of Lot Thirty-three (33)
distant Thirty-two (32) feet South of the Northwest corner
thereof; thence East to the East .line of Lot Thirty-two (32);
thence South Seventy-five (75) feet; thence West to the
East line of Lot Thirty-three (33); thence South Twenty (20)
feet; thence West to the West .line of Lot Thirty-three (33);
thence Southwesterly to a point on the West .line of Lot
Thirty-one (31) distant Two Hundred Forty-five (245) feet
North of the South .line of the Northwest Quarter (NW-1) of
Section Two (2), Township One Hundred Eighteen (.1.18), Range
Twenty-one (2.1); thence North Ninety-five (97) feet to
beginning; except road,
approximately as shown shaded on the map marked Exhibit A and made a part hereof.
The grant herein contained shall be subject to the following conditions:
1. Any expense to Grantor caused by the grading, maintenance, construction
or use of the easement permitted by this easement, shall be borne by Village.
2. In the event Village at any time discontinues the use of the property
for the purpose granted herein, then and in such event this easement together
with all rights and privileges granted hereunder, shall terminate.
3. Upon termination of this grant, Village shall restore or regrade the
above described property to a. condition satisfactory to Grantor,

pertinent codes and ordinances.
5. Nothing herein contained shall be deemed to restrict in any
way the continued use of the said property by NSP for the construction,
operation, or maintenance of its electric transmission or distribution
lines and appurtenant facilities located or to be located thereon, or with
other uses of the land not inconsistent with the right herein granted.
TO HAVE AND TO HOLD SAID EASEMENT, unto the said Village and its
successors and assigns for the purposes aforesaid, for a term of five
years from the date

Request: Site and Building Plan Approval
The applicant proposes an addition to the office portion of the automobile
dealership, and numerous site upgrading improvements. A master plan fo: the
site has been developed, comprehending use of the adjacent N.S.P. property
which may be acquired (there is current unauthorized use of this unpaved area) .
The plan is basically in order, with the exception of finalizing the extent of
improvements. If the N.S.P. property is not owned by the applicant, proper
• documentation and approval of joint use is necessary. If such documentation
is not possible now, then the approval can only comprehend use of the applicant's
property -- and the plans should clearly reflect this.
The plans indicate several improvements which were not originally installed:
curb and gutter; green strips; paving of all driveway and parking areas; installation
of automatic fire extinguishing system; and underground irrigation.
We will be prepared to review the plans in detail and to recommend possible
deferment of certain curbing pending development of the commercial land to the
no rth .
Approval would be subject to at least the following:
1 . Building Plans are subject to approval by the Building
Official with respect to applicable codes.
2. Grading, drainage, and utility plans are subject to review
by the City Engineer, and a grading and drainage plan
prepared by a registered engineer shall be submitted prior
to installation of the required improvements.
3. A performance agreement and supporting financial
guarantee (in an amount determined by the City Manager)
shall be submitted to assure completion of approved
improvements.
4. All outside trash disposal facilities shall be appropriately
screened
5. The buildings shall be equipped with automatic fire
extinguishing systems per N.F.P.A. Standard No. 13.
6. Underground irrigation shall be installed in all approved
landscaped areas
