Such a meeting was hold on June 13 in the Social Hall ,the Secretary, chairman Grass and commissioner Foreman were present) The applicant seeks a special use permit to operate a supervised home for developmentally disabled persons, per the provision. of Section 35-310 for "other noncommercial uses required for the public welfare in an R-1 district, as detezmined by the City COUnCil o " The intent is tc prop side a setting in which the Oatreach clients may acquire basic home living skills though daily ex- perience in a standard homey envvircrzmert. The applicant contends that the outreach Program promotes the public welfare by providing a means for integrating the developmentally �... disabled into society as dependence upon institutions is phased down. Whereas it is the stated intent of this program to draw upon the resources of the residential environment, the basic issue is what the impact of the proposed use would have upon the established residential character of the single family n*ighbcf•rhood. The questioh before the Ctmmission is one of fact Finding and degrees what is the nature of the special use and to what extent is it ccm- patible with the established permitted use? As a zoning matter, it should be evaluated in terms of ordinance criteria for a special use; rind© more -specifically in terms of density and physical characteristics of the proposed group home. The .planned house has six and potentially seven bedrooms two levels four and cane --half baths y and one cooking -eating area. The applicant. proposes residency by a supervisory couple and two children on the upper level® and occupancy by six outreach clients on the lower level.. According to the applicant's information the use in volves the family of the supervisor plus the group of clients. TOM would most logically be consistent with the ordinance provision for boarding care home.. The special character in either case is the degree to which the use departs srom the R-1 character of the neighborhood. The number of residents is a significant criteria teria in defining the point at which the home becomes a satellite institution -rather than a single family type home c:i th a specially permitted use as in the case of day care or foster care facilities. 3. other uses of the facility. Whereas "programs" are potentially tenuous and transferrable to various locations, structures relatively are not. The issue is whether the proposed home is adaptable to single family occupancy. obviously the opeeial permit is not a rezoning, buy: the home is generally "single purpose" in design for group living purposes. Significantlye boarding care homes are a permitted special use 3n the R--4a R--5 and C-Z di.s•triets. However, family clay care and foster care uses are permitted home occupations in the R I district. Also, there is a group home in an R --1 distrIct, occupying an existing larger house; another group heave, formally acknowledged, is in a large a listing house in the R-5 district. There is little doubt, as to the intent and capabilities of the Outreach Program. Location of the physical facilities and the msgniteade of the home operations are natters. of discretion W policy, however --- specifically in tight of canmunity zoning require-menstcs. it is evident from the applicant's i,nf'ormation that a great cleal of planning occured with respect to the needs and desires of the Qvtreach concept, prior to any inquiry as to zoning and policy requirements. The applicant proposes to construct a single family dwelling which would serve as a home for. not more than six persons who are "developmentally disabled", according to Mr. Flick Schifflet, a professional with the Outreach Conmiunity Center. According to information supplied by Mr. Schxfflet, the residents would be under the supervision of horse managers --parents and would be employed. The intent i, to provide assistance in basic horse living skills through daily experience in a standard home environment.. �— A descriptive statement by the applicant is attached, as iz a collection of news articles concerning the establishment of a similar home in *Richficeld and the efforts of the applicant in supporting this concept. Neighboring property owners have been notified of the hearing. The Ordinance Standards for a Special Use are set forth in Section 35-220(2): a.
