The applicant's hone at this site was deimlished following an explosion and fire in February, 1975. Also requested is a side yard setback variance to accommodate the proposed house. Several technical variances from Section 35-400 are involved: 1. .4idth: 33 foot variance from the 75 foot requirement (or, 19.,5 foot -- variance from the"70% rule" which rviou?d permit construction on a 52.5 foot wide lot) 2. Area: 3,213 sq.ft. variance from the 9,,500 sq.ft. requirement (or, 363 sq.ft. variance from the "70% rule" which would permit construction on a 6,650 sq.ft. lot.) 3. Side yard setback: The applicant proposes a 25 -Foot aide house, re - setback, vs. t:he required 10 foot, on the north side. The parcel was created many years ago; through metes and bounds description, as the north 1/3 of Lot 14 which was platted at 126 feet. The balance of the lot is owned by the occupant next door at 5324 Bryant. There is 40 feet between the Grouse at 5324 and the north line of the subject parcel. The applicant contends that attempts to purchase additional land from the neighbor have been fruitless. There is precedent for such action, the most recent being Application No. 75015 submitted by .lames Hannay at 5449 Emerson, That case involved a 40 ft. platted lot and the approval comprehended permission to build and a 3 foot sideyard setback variance on both sides of the proposers house. While both premises are in the R-•2 zoned southeast neighborhood, there are at least two differences: unlike the Emserson Avenue parcel, the subject property does not abut an alley; and there is vacant adjacent land. An additional 10.5 feet would bring the parcel wi-16-hin the limits of the 70% rule. The proposed 7 foot sideyard setback on the north side would not be necessary if the lot were widened. If the lot cannot be widened for reasons deemed appropriate, and the request is held to be in order, there is merit to the setback variance request ---to accom ndate a miniml dvrellirg size. P.C. Page 2 However, it is recortnended the variance he -for the south sideyard rather than. the north, in consideration of the proximity of theaJacent dwelling to the south which is approximately 6.5 feet from the property line.
