Description of Request: Mr. Maertens wishes to divide and
sell his lot in such a manner that
his rear yard setback and the
average depth of the new lot will
be less than those minimums required
by the City Ordinances.

Addition.
BACKGROUND:
1) A variance from Section 35-400 which requires a 40' rear
yard setback (38' average proposed).
2) A variance from Section 15-104 which requires submission
of a preliminary plat when subdividing property.
3) A variance from Section 15-106 (g) 2. (dd) which requires
110' of average depth to a lot (105' proposed).
4) Dividing as proposed, the new lot would have approximately
11.625 square feet and the existing lot would be reduced
to 17,110 square feet.
POINTS TO BE CONSIDERED:
1) The variance from Section 15-104, submission of a preliminary
plat, is required because the present ordinance does not
provide. for minor subdivisions.
2) The applicant intends to raze a garage from what will
become the new lot and a stoop attached to the rear of
his house.
3) Setbacks.
