Request: Variance
The applicant is seeking a variance from Chapter 35 to permit an addition to an
existing house which is noncomplying with respect to Zoning Ordinance setback
standards. The property is R-2 and the structure was built in 1929; our records
indicate that plumbing and electrical systems have been upgraded since then. The
proposed addition is 10 ft. by 12 ft. and it is within the ordinance setback
standards.
The property is a "double lot" for this area and is 126 ft. in width. The noncom-
plying aspect of the main structure is that it is approximately 22 ft. from the
front property line. Adjacent dwellings and other dwellings in this general area
are less than 35 ft. from the front property line.
A public hearing has been scheduled.
The Building Official reports that the dwelling appears to be in sound condition,
and it is our opinion the proposed addition and upgrading would be of benefit to
this neighborhood.
There have been several similar variance actions in recent years, including
Applications No. 75016 and No. 76042. Approval of those applications was generally
based on the finding that the request satisfies the intent of the ordinance
standards for variance, noting in particular that the situation was not created by
the applicant; the proposed addition does not involve the yard deficiency; and
similar actions for neighboring and area properties with the resulting enhancement
of the older Southeast Neighborhood.
Approval would be subject to the following:
a. The proposed addition shall conform with applicable yard setback
requirements.
b. The exterior finish of the addition shall be compatible with that
of the dwelling.
c. The construction shall be in accordance with all applicable codes
as determined by the Building Official.
